HomeMy WebLinkAbout1996-01-23; City Council; Resolution 96-361 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 96-36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD CALIFORNIA DECLARING THE CITY’S INTENTION TO HOLD A PUBLI( HEARING ON THE ABATEMENT OF A PUBLIC NUISANCE AT 168! CHESTNUT AVENUE, APN 205-220-26-00. WHEREAS, the conditions which exist at 1685 Chestnut Avenue, Assessor’ Number 205-220-26-00 are alleged to constitute a public nuisance as defined in Section 6.16.010 of the Carlsbad Municipal Code; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of C California, as follows: 1. 2. That the above recitations are true and correct. That the City has the power at both common law and by ordinance 1 nuisances. 3. That the City Council has established procedures for the abatement oi nuisances within the City limits. 4. That the City Council will hold a public hearing on February 13 ~ in the City Council Chambers at 1200 Carlsbad Village Drive, Carlsbad, California to c whether or not the conditions on the property described as 1685 Chestnut Avenue co a public nuisance and will hear and consider any and all evidence and objections. That if a public nuisance is found to exist it will be ordered abatec expense of the property owner(s) and such expense shall become a lien and assessment against property and a personal obligation of the property owner maintair pu bl ic nu i sance. 6. 5. That the Community Development Director of the City of Carlsbad wi this resolution to be posted according to law, and also cause the notice to be sen property owner(s) and all parties that hold interest in the subject property that t Council will hold a public hearing February 13, 1996 to determine whi not the conditions constitute a public nuisance. That based upon the facts presented at the public hearing, the City Cour determine whether or not a public nuisance exists, and if it exists the City Council wi that the public nuisance be abated at the expense of the person(s) creating it and the F owner(s).
