RESOLUTION NO. 96-76
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A NEGATIVE
DECLARATION, SPECIFIC PLAN AMENDMENT,
TENTATIVE MAP REVISION, PLANNED DEVELOPMENT
PERMIT AMENDMENT, AND SITE DEVELOPMENT PLAN
AMENDMENT, ON PROPERTY GENERALLY LOCATED
EAST OF PASEO DEL NORTE, NORTH OF CAMINO DE
LAS ONDAS, WITHIN SPECIFIC PLAN 203 IN LOCAL
FACILITIES MANAGEMENT PLAN ZONE 20 IN THE
SOUTHWEST QUADRANT OF THE CITY.

WHEREAS, on January 3, 1996 the Planning Commission held a c
noticed public hearing to consider a Negative Declaration, Specific Plan Amendrr
(SP 203(A)), Tentative Map Revision (CT 92-01 (A)), Planned Development Pe
Amendment (PUD 92-01 (A)), and Site Development Plan Amendment (SDP 93-04(
for project development on 28.39 acres of land and adopted Planning Commis:
Resolutions No. 3862, 3863, 3864, 3865, and 3866 respectively, recommenc
approval to the City Council; and
WHEREAS, the City Council of the City of Carlsbad, on dab
MARCH , 1996, held a public hearing to consider the recommendations and hc
all persons interested in or opposed to SP 203(A)/CT 92-01 (A)/PUD 92-01 (A)/SDP
04(A); and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the Cit
Carlsbad as follows:

2. That the Negative Declaration on the above referenced projec
approved, and that the findings and conditions of the Planr
Commission contained in Planning Commission Resolution No. 3862
file with the City Clerk and incorporated herein by reference, are
findings and conditions of the City Council.
That the above recitations are true and correct.

3. That the recommendation of the Planning Commission for the apprc
of the Specific Plan Amendment (SP 203(A)) is approved and that
findings and conditions of the Planning Commission containec
Planning Commission Resolution No. 3866, on file with the City Clerk
incorporated herein by reference, are the findings and conditions of
City Council and Ordinance NS-349 shall be contemporaneo
ad opted.
That the recommendation of the Planning Commission for the apprl
of the Tentative Map Revision (CT 92-01(A)) is approved and that
findings and conditions of the Planning Commission containec
Planning Commission Resolution No. 3863, on file with the City Clerk
incorporated herein by reference, are the findings and conditions of
City Council
That the recommendation of the Planning Commission for the apprl
of the Planned Development Permit Amendment (PUD 92-01 (A)
approved and that the findings and conditions of the Plani
Commission contained in Planning Commission Resolution No. 3864
file with the City Clerk and incorporated herein by reference, are
findings and conditions of the City Council.
That the recommendation of the Planning Commission for the appr
of the Site Development Plan Amendment (SDP 93-04(A)) is apprc
and that the findings and conditions of the Planning Commisi
contained in Planning Commission Resolution No. 3865, on file with
City Clerk and incorporated herein by reference, are the findings
conditions of the City Council.

"NOTICE TO APPLICANT"
"The time within which judicial review of this decision must bc
sought is governed by Code of Civil Procedure, Section 1094.6
which has been made applicable in the City of Carlsbad by Carlsbac
Municipal Code Chapter 1.16. Any petition or other paper seekin!

final; however, if within ten days after the decision becomes final i
