CASE NAME: RANCHO VERDE CASE NO: SDP 95-07 WHEREAS, on February 7, 1996, the Carlsbad Planning Commis: held a duly noticed public hearing to consider the Site Development Plan SDP 9E and adopted Planning Commission Resolution No. 3895 recommending to the 1 Council that SDP 95-07 be approved; and WHEREAS, the City Council of the City of Carlsbad, on the 26th , 1996 held a public hearing to consider the recommendations ( day of March heard all persons interested in or opposed to the Site Development Plan; and WHEREAS, a Mitigated Negative Declaration and the Mitiga Monitoring and Reporting Program was prepared for the prior subdivision of subject property and was considered to be adequate for the analysis of the propo SDP; and WHEREAS, a Notice of Prior Compliance was issued; and WHEREAS, the City Council of the City of Carlsbad this day 26th , 1996, held a public hearing to consider Site Development Plan 5 March 95-07 and the comments of all persons wishing to be heard on the matter. NOW THEREFORE, BE IT RESOLVED by the City Council of the Cit Carlsbad, California that: 1. 2. That the above recitations are true and correct. That the recommendation of the Planning Commission for approval of the Site Development Plan, SDP 95-07 is appro and that the findings and conditions of the Planning Commis: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 e contained in Planning Commission Resolution No. 3895, on with the City Clerk and incorporated herein by reference are findings and conditions of the City Council. That this action is final the date this resolution is adopted by City Council. The provision of Chapter 1.16 of the Carlsl Municipal Code, "Time limits for Judicial Review" shall apply 3. "NOTICE TO APPLICANT" "The time limit within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by the Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate court no later than the ninetieth day following the date on which this decision becomes final; however, if within ten days after the decision becomes final a request for the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost for the preparation of such record, the time within which such petition may be filed in the court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney or record, if he has one.
