HomeMy WebLinkAbout1996-10-01; City Council; Resolution 96-321. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 RESOLUTION NO. 9 6 - 3 2 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A VESTING TENTATIVE MAP REVISION, PLANNED DEVELOPMENT PERMIT AMENDMENT, SITE DEVELOPMENT PLAN AMENDMENT, AND HILLSIDE DEVELOPMENT PERMIT AMENDMENT TO SUBDIVIDE A 68.5 ACRE PROPERTY INTO LOTS, 42 OWNERSHIP POSTAGE STAMP LOT TOWNHOMES ONE COMMUNITY FACILITY SITE, ON PROPERTY GENERALLY LOCATED EAST OF PASEO DEL NORTE, NORTH OF CAMINO DE LAS ONDAS, SOUTH OF PALOMAR AIRPORT, IN LOCAL FACILITIES MANAGEMENT PLAN ZONE 20. CASE NAME: SAMBI SEASIDE HEIGHTS 137 SINGLE-FAMILY LOTS, 98 TWINHOMES ON SMALL AFFORDABLE TO LOWER-INCOME HOUSEHOLDS, AND CASE NO.: CT92-02(A)/PUD92-03 (A)/SDP92-06(A)/ HDP92-03(A) WHEREAS, on August 21, 1996, the Planning Commission held a duly public hearing to consider a Vesting Tentative Map Revision (CT 92-02(A)), Development Permit Amendment (PUD 92-03(A)), Site Development Plan Amendmer 92-06(A)), and Hillside Development Permit Amendment (HDP 92-03 (A)) for development on 68.5 acres of land and adopted Planning Commission Resolutions Nc 3978, 3979, and 3980 respectively, recommending approval to the City Council; and 1st WHEREAS, the City Council of the City of Carlsbad, on the day of October , 1996, held a duly noticed public hearing to cons recommendations and heard all persons interested in or opposed to CT 92-02(A), PUD 9 SDP 92-06(A), and HDP 92-03(A); and NOW, THEREFORE, BE IT RESOLVED by the City Council of the Carlsbad as follows: 1. That the recommendation of the Planning Commission for the approval of Development Plant Amendment (SDP 92-06(A)) is approved and that the . and conditions of the Planning Commission contained in Planning Corn Resolution No. 3979, on file with the City Clerk and incorporated he reference, are the findings and conditions of the City Council. This action is final the date this resolution is adopted by the City Counc provisions of Chapter 1.16 of the Carlsbad Municipal Code, “Time Lir Judicial Review” shall apply: 2. 3. 4. 5. “NOTICE TO APPLICANT” “The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate court not later than the nineteenth day following the date on which this decision becomes final; however, if within ten days after the decision becomes final a request for the record of the deposit in an amount sufficient to cover the estimated cost or preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one.
