A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLS BAD , CALI FORN IA, AP PROW N G AN
AMENDMENT TO ALL SIX SEGMENTS OF THE
CARLSBAD LOCAL COASTAL PROGRAM TO ADOPT THE
CITY’S GRADING ORDINANCE AS AMENDED AS AN
IMPLEMENTING ORDINANCE FOR CARLSBAD’S LOCAL
COASTAL PROGRAM.
CASE NAME: GRADING ORDINANCE
CASE NO: LCPA 96-08
WHEREAS, California State law requires that the Local Coastal Prl
General Plan, and Municipal Code regulations for properties in the Coastal Zonr
conformance; and
WHEREAS, the City of Carlsbad is processing for approval a new E
and erosion control ordinance entitled “Ordinance No. NS - 385 ”
December 3 , 1996, hereinafter referred to as Exhibit No. 1.
WHEREAS, a verified application for an amendment to the Local (
Program, as shown on Exhibit No. 1 , has been filed with the City Council; and
WHEREAS, said verified application constitutes a request for i
Coastal Program Amendment as shown on Exhibit No. 1, as provided in
Resources Code Section 30574 and Article 15 of Subchapter 8, Chapter 2, Divk
of Title 14 of the California Code of Regulations of the California Coastal Comi
Administrative Regulations; and
WHEREAS, the City Council did on the 19th day of November
1996, hold a duly noticed public hearing as prescribed by law to consider said r

WHEREAS, State Coastal Guidelines requires a six week public
period for any amendment to the Local Coastal Program.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Coi
the City of Carlsbad, as follows:

That the foregoing recitations are true and correct.
At the end of the State mandated six week review period, starl
August 22, 1996, and ending on October 4, 1996, staff shall pre

comments have been received.
That based on the evidence presented at the public hearing, tt

1. That the proposed Local Coastal Program Amendment is consistent \
applicable policies of the City of Carlsbad Local Coastal Program (LC

3. That the Planning Director has determined that the project is exempt frr
requirements of the California Environmental Quality Act (CEQA) per St
15308, 1506l(b)(3), and 15273(a)(1) of the State CEQA Guidelines and '
have any adverse significant impact on the environment.
