HomeMy WebLinkAbout1996-12-17; City Council; Resolution 96-435* 1 2 3 4 5 6 7 8 9 lo 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 RESOLUTION NO. 9 6 - 435 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REIMBURSEMENT AGREEMENT WITH THE CITY OF LOS ANGELES, AND APPROVING A CONSULTANT AGREEMENT TO CONDUCT LONG TERM BIOLOGICAL MONITORING AT BATIOUITOS LAGOON CARLSBAD, CALIFORNIA, APPROVING A The City Council of the City of Carlsbad, California, does hereby re fOllOWS: WHEREAS, the CITY COUNCIL has previously entered into various agr with the Board of Harbor Commissioners of the City of Los Angeles (Board) regarc Batiquitos Lagoon Enhancement Project: and WHEREAS, City of Carlsbad is permittee for the restoration of Bi Lagoon and responsible for special conditions of the Coastal Development Permit, Del of Army Permit and Stream Alteration Agreement which require implementation of a 1( monitoring program; and WHEREAS, Board has agreed to reimburse the City of Carlsbad for the 1( biological monitoring required by said permits; and WHEREAS, the City of Carlsbad staff in coordination with Board s various resource agencies, issued a Request for Proposals to conduct long term monito through this process has selected a consultant to conduct long term monitoring of the lag( WHEREAS, by this action the City Council hereby finds it necessary, d and in the public interest to award a long term monitoring contract for the Batiquitos Proj WHEREAS, the Board has approved a reimbursement Agreement (LAH 7) for long term monitoring services and City of Carlsbad administrative costs. 1 2 3 4 5 6 7 8 9 10 11 12 13 l4 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the Carlsbad, California as follows: 1. 2. That the above recitations are true and correct. That a reimbursement agreement with the Board of Harbor Commissione City of Los Angeles regarding funding, and administration of the long term bi monitoring has been prepared and is hereby approved in the not-to-exceed am $1,883,876.00 and the Mayor, upon receipt of the signed copies of the reimbursement ag is authorized to execute said agreement. Following the City’s execution of said agreen City Clerk is directed to return five signed original copies of the agreement to the POI Angeles, Attention: Dr. Ralph Appy, Assistant Director of Environmental Managem South Palos Verdes Street, PO Box 151, San Pedro, California 90733-0151, and on Xerox copy to the Community Development Department. 3. That in accordance with Federal, State and Local laws, statutes, regulatic ordinances, the City Council hereby awards a contract to Merkel and Associates, Inc amount of $1,694,168.00 to conduct the long term biological monitoring. The City authorizes the Mayor, upon receipt of the signed copies of the reimbursement agree] execute said contract following the acceptance and approval by the City of the COI requirements to be provided by said company.
