CITY COUNCIL RESOLUTION NO. 97-87
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA TO APPROVE AN AMENDMENT
CONDITION NUMBER 9 AS RELATED TO
CONSTRUCTION OF PARKING AND A THIRD ACCESS
FOR THE VILLAGE COMMUTER RAIL STATION.
TO CITY COUNCIL RESOLUTION NO. 93-304 TO MODIFY
WHEREAS, the City Council, at their meeting on November 2, 1
approved the design and site plans for the Carlsbad Village Commuter
StatiodTransit Station subject to the findings and conditions contained in
Council Resolution No. 93-304; and
WHEREAS, North County Transit District has requested a modific
to one of the conditions of approval which requires concurrent construction of a
access to the expanded parking lot for the Village Commuter RaiVTransit Station
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Counc
the City of Carlsbad, California, as follows:
A) That the above recitations are true and correct.
B) That the City Council hereby APPROVES a modification to Condition No.
City Council Resolution No. 93-304, dated November 2, 1993, to rea

"NCTD shall be responsible for acquiring the property necessary
completing the required improvements, as set forth by the City Engineer, to cons
an additional public street access for the expansion of the parking lot at the V
Commuter RaiVTransit Station. NCTD shall enter into a standard "Develop
Improvement Agreement" with the City of Carlsbad, to be approved and executc
the Community Development Director, and provide security satisfactory to the C
Finance Director to ensure construction of the third (additional) access within tv
(1 2) months of the initiation of construction for the expanded parking lot, unle:
extension of time is granted by the City Council. The location for the third ac
shall be approved by the City of Carlsbad's City Engineer. All plans, specifica
and supporting documents for all improvements and landscaping, as related tc
third access, shall be prepared by NCTD to the satisfaction of the City Engineer
plans shall be prepared on standard City plan sheets and be processed througl
normal City plancheck process and the work shall be inspected by City forces. If
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
Council of the City of Carlsbad, California, held on the 4th day of March, 199
the following vote, to wit:
AYES: Council Members Lewis, Finnila, Nygaard, Kulchin, Hall
NOES: None
