RESOLUTION NO. 97-448
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING THE RESCISSION OF CONSULTANT
AGREEMENTS WITH O’DAY CONSULTANTS, INC., FOR THE DESIGN
OF IMPROVEMENT PLANS, PROJECT SPECIFICATIONS AND COST
ESTIMATES FOR CANNON ROAD WEST AND MCDANIEL
ENGINEERING FOR BRIDGE DESIGN SERVICES FOR CANNON
ROAD: MACARIO CANYON BRIDGE AND AGUA HEDIONDA BRIDGE
AND APPROVING A CONSULTANT AGREEMENT WITH O’DAY
CONSULTANTS, INC., FOR THE DESIGN OF THE IMPROVEMENT
PLANS, PROJECT SPECIFICATIONS, AND COST ESTIMATES FOR
CANNON ROAD WEST. PROJECT NO. 3184.
WHEREAS, Transnet funds are available in the Cannon Road West account; and
WHEREAS, staff has previously solicited proposals from qualified civil engineerin!
to provide these necessary services to the City; and
WHEREAS, through a consultant selection process, O’Day Consultants, Inc
selected as the most qualified civil engineering firm; and
WHEREAS, it is in the best interest of the project to combine the design contra
McDaniel Engineering and O’Day Consultants, Inc., to insure coordination; and
WHEREAS, it is in the best interest of the City to approve the rescission of the e
contracts and approve a new contract; and
WHEREAS, additional items required for the environmental permitting proces5
been identified in initial consultation with regulatory agencies and the design of those iter
been added to the contract; and
WHEREAS, a consultant agreement with O’Day Engineering, Inc., has been prl
and submitted hereto.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ca
California, as follows:
1. That the above recitations are true and correct.
2. That the funds of $41 5,076 are available in the Cannon Road account.
3. That the rescission of the existing consultant agreement between the
Carlsbad and McDaniel Engineering is hereby approved.

Inc., is hereby approved and the Mayor is authorized and directed to execute said agreemc
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbal
Council held on the 15th day of April , 1997 by the following vote, to wit:
AYES: Council Members Lewis, Finnila, Kulchin and Hall
NOES: None
ABSENT: Council Member Nygaard
