RESOLUTION NO. 97-496
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAESBAD, CALIFORNIA, APPROVING A NEGATIVE
DECLARATION AND LOCAL COASTAL PROGRAM
AMENDMENT FOR A ZONE CODE AMENDMENT
ADDING CHAPTER 21.83 TO THE CARLSBAD MUNICIPAL
CODE AND AMENDING VARIOUS SECTIONS OF THE
ZONING ORDINANCE TO ADDRESS THE PROVISION OF
SMALL AND LARGE FAMILY DAY CARE HOMES AND
CHILD DAY CARE CENTERS.

WHEREAS, pursuant to the provisions of the Municipal Code, tl
Planning Commission did, on May 7, 1997 and May 21, 1997 hold a duly noticed pub1
hearing as prescribed by law to consider a Negative Declaration and Local Coastal Progra
Amendment; and
WHEREAS, the City Council of the City of Carlsbad, on the 17th dz
of June , 1997, held a duly advertised public hearing to consider said Negativ
Declaration and Local Coastal Program Amendment and at that time received th
recomrnendations, objections, protests, comments of all persons interested in or opposed tc
ZCA 93-01 and LCPA 97-03; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of thc
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the City Council APPROVES City Council Resolution No. 97-45
and that the findings and conditions of the Planning Commission as set
forth in Planning Commission Resolutions No, 4092,4093, and 4094 on
file with the City Clerk and made a part hereof by reference are the
findings and conditions of the City Council.

PASSED, APPROVED AND ADOPTED at a regular meeting of the City
COUNCIL of the City of Carlsbad, California, on the 17th day of June 7
1997, by the following vote, to wit:
AYES: Council Members Lewis, Finnila, Nygaard, Kulchin, and Hall
