CASE NAME: AVIARA PLANNING AREA 23 CASE NO.: MP 177(R)/GPA 96-02/LCPA 96-02 WHEREAS, pursuant to the provisions of the Municipal Code, the P1; Commission did, on June 4, 1997, hold a duly noticed public hearing as prescribed by consider a Negative Declaration, Master Plan Amendment, General Plan Amendment and Coastal Program Amendment; and DECLARATION, ADDENDUM 2 TO MEIR 93-01, MASTER WHEREAS, the City Council of the City of Carlsbad, on the 24th t June , 1997, held a duly advertised public hearing to consider said Ne Declaration, Addendum 2 to MEIR 93-01, Master Plan Amendment, General Plan Amen and Local Coastal Program Amendment and at that time received recommendations, objet protests, comments of all persons interested in or opposed to MP 177(R)/GPA 96-02/LCF 02; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the City Council APPROVES City Council Resolution No. 97-515 , that the findings and conditions of the Planning Commission as set fol Planning Commission Resolutions No. 4 1 13, 41 14, 41 15 and 41 16 on file the City Clerk and made a part hereof by reference are the findings and cond of the City Council. 3. That the application for Master Plan Amendment (MP 177(R)) to revise pern uses and development standards for Aviara Planning Area 23 for property lo north of Aviara Parkway west and east of Black Rail in LFMP Zone approved as shown in Planning Commission Resolution No. 41 14 on file wir City Clerk and incorporated herein by reference. 4. That the General Plan Amendment (GPA 96-02) to change an 18.3 acre I from Neighborhood Commercial to Residential Medium Density on prc located north of Aviara Parkway, west and east of Black Rail Court in I Zone 19 is approved as shown in Planning Commission Resolution No. 41 file with the City Clerk and incorporated herein by reference. 5. That the Major Local Coastal Program Amendment (LCPA 96-02) to implementing ordinance of the Mello I (Aviara Master Plan) to revis , permitted land uses and development standards for the Aviara Master Plan 7 Aviara Planning Area 23 on property located north of Aviara Parkway, we east of Black Rail Court in LFMP Zone 19 is approved as shown in Pla Commission Resolution No. 41 16 on file with the City Clerk and incorpc herein by reference. ... ... ... ... ... ... ... ... ... ...
