HomeMy WebLinkAbout1997-06-24; City Council; Resolution 97-520v I I1 0 0 1 2 3 4 5 RESOLUTION NO. 97-520 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, INITIATING PROCEEDINGS FOR THE ANNUAL LEVY OF ASSESSMENTS AND ORDERING THE PREPARATION OF AN ENGINEERS REPORT FOR A SPECIAL MAINTENANCE DISTRICT 6 WHEREAS, the City Council of the City of Carlsbad, California has previously formc 'P 1972, being Division 15, Part 2 of the Streets and Highways Code of the State of Californ 8 a special maintenance district pursuant to the terms of the Landscaping and Lighting Act said special maintenance district known and designated as Street Lighting and Landscapil 9 lo District No. 1 (hereinafter referred to as the Maintenance District); and, l1 ll WHEREAS, the Maintenance District is an existing assessment district in whi 12 13 assessments are not proposed to be increased, and is exempt from the procedures a requirements of all assessments under California Constitution Act XlllD § 5 (a). 14 15 16 17 18 19 WHEREAS, the City Council wishes to take proceedings to provide for the ann1 levy of assessments for the next ensuing fiscal year to provide for the annual costs i maintenance of improvements defined as existing street lighting, median landscaping a street trees, within the Maintenance District. NOW THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: 20 II RECITALS 21 22 SECTION 1. That the above recitals are true and correct. DECLARATION OF INTENTION 23 24 legislative body to levy and collect assessments to pay the annual costs and expenses 25 the maintenance and/or servicing of the improvements for the above referenc 26 Maintenance District, said improvements generally described as follows: 27 landscaping improvements, as set forth and described in the Engineer's Report. That this improvement is hereby referred to the engineer who is herel 9 REPORT OF ENGINEER 8 lo 11 directed to make and file the Report generally containing the following: 12 13 A. Plans and specification describing the general nature, location and extent of tl improvements; B. An estimate of the cost of the maintenance and/or servicing of the improvements 1 14 15 16 17 18 19 I 20 the Maintenance District for the referenced fiscal year; C. A diagram for the Maintenance District, showing the area and properties proposed be assessed; D. An assessment of the estimated costs of the maintenance andlor servicing, assessil the net amount upon all assessable lots andlor parcels within the Maintenance District proportion to the benefits received. I 21 22 That upon completion of the preparation of said Report, the original shall be filed with tt City Clerk, who shall then submit the same to this legislative body for its immediate revie 23 24 and consideration. FISCAL YEAR SECTION 4.
