RESOLUTION NO. 97-692
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A TENTATIVE
MAP, PLANNED DEVELOPMENT PERMIT, HILLSIDE
DEVELOPMENT PERMIT, AND COASTAL DEVELOPMENT
PERMIT TO SUBDIVIDE 150 SMALL SINGLE FAMILY
OPEN SPACE LOTS, TWO RECREATION LOTS, AND ONE
RECREATIONAL VEHICLE LOT ALL ON PROPERTY
GENERALLY LOCATED SOUTH OF PALOMAR AIRPORT
ROAD, EAST OF HIDDEN VALLEY ROAD, AND EAST AND
WEST OF FUTURE AVIARA PARKWAY

The City Council of the City of Carlsbad, California, does hereby reso
LOTS, ONE MULTI-FAMILY AFFORDABLE LOT, TWO
follows:
WHEREAS, on October 15, 1997, the Planning Commission held a duly n
public hearing to consider a Tentative Map (CT 97- 14) , Planned Development Permit (PL
1 1), Hillside Development Permit (HDP 97-13), and Coastal Development Permit (CDP 5
for project development of 53.7 acres of land and adopted Planning Commission Resolutic
41 86, 41 87, 41 89, and 4190 respectively, recommending to the City Council that th
approved; and
WHEREAS, on October 23, 1997, the Housing Commission held a duly n
public hearing to also consider the project and adopted Housing Commission Resolution N
01 3 recommending to the City Council that it be approved; and
WHEREAS, the City Council of the City of Carlsbad, on the 18th d
November , 1997, held a public hearing %o consider the recommendations and heard all PC
interested in or opposed to CT 97-14, PUD 97-1 1 , HDP 97-1 3, and CDP 97-34.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the C
Carlsbad as follows:

1. That the above recitations are true and correct.
2. That the recommendation of the Planning Commission for the apprc
the Tentative Map (CT 97-14) is approved and that the findini
conditions of the Planning Commission contained in P1;
Commission Resolutions 4186 on file with the City Clerl
incorporated herein by reference are the findings and conditions
City Council.
3. That the recommendation of the Planning Commission for the apprc
the Planned Development Permit (PUD 97-1 1) is approved and tl
findings and conditions of the Planning Commission contair
Planning Commission Resolution No. 41 87, on file with the City
and incorporated herein by reference, are the findings and conditi
the City Council.
4. That the recommendation of the Planning Commission for the apprc
the Hillside Development Permit (HDP 97-13) is approved and tl
findings and conditions of the Planning Commission contain
Planning Commission Resolution No. 4189, on file with the City
and incorporated herein by reference, are the findings and conditi,
the City Council.
5. That the recommendation of the Planning Commission for the apprc
the Coastal Development Permit (CDP 97-34) is approved and ti
findings and conditions of the Planning Commission contain
Planning Commission Resolution No. 4190, on file with the City
and incorporated herein by reference, are the findings and conditi
the City Council.
6. That the recommendations of the Housing Commission for the apprc
the project are approved and that the findings and conditions
Housing Commission contained in Housing Commission Resolutio
97-013, on file with the City Clerk and incorporated herein by refe
are the findings and conditions of the City Council.
7. This action is final the date this resolution is adopted by the City Cc
The provisions of Chapter 1.16 of the Carlsbad Municipal Code,
Limits for Judicial Review” shall apply:
“NOTICE TO APPLICANT”
“The time within which judicial review of this decision must be sought is
governed by Code of Civil Procedure, Section 1094.6, which has been
made applicable in the City of Carlsbad by Carlsbad Municipal Code
Chapter 1.16. Any petition or other paper seeking judicial review must be

filed in the appropriate court not later than the nineteenth day following
the date on which this decision becomes final; however, if within ten days
after the decision becomes final a request for the record of the deposit in
an amount sufficient to cover the estimated cost or preparation of such
record, the time within which such petition may be filed in court is
extended to not later than the thirtieth day following the date on which the
record is either personally delivered or mailed to the party, or his attorney
of record, if he has one. A written request for the preparation of the record
of the proceedings shall be filed with the City Clerk, City of Carlsbad,
1200 Carlsbad Village Drive, Carlsbad, CA 92008.”
PASSED AND ADOPTED at a regular meeting of the City Council of the C
Carlsbad on the 18th day of November , 1997 by the following vote, to wit:
