HomeMy WebLinkAbout1998-02-10; City Council; Resolution 98-32* ?' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 RESOLUTION NO. 98-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING SITE ADDITIONAL BUILDING HEIGHT UP TO 42 FEET INCLUDING ARCHITECTURAL PROJECTIONS FOR CONSTRUCTION OF A 17 UNIT TIMESHARE/HOTEL EXPANSION ON PROPERTY GENERALLY LOCATED AT THE NORTHEAST CORNER OF ISLAND WAY AND SURFSIDE LANE IN LOCAL FACILITIES MANAGEMENT ZONE 22. CASE NAME: SEAPOINTE RESORT EXPANSION CASE NO.: SDP 94-04(B) The City Council of the City of Carlsbad, California, does hereby resol DEVELOPMENT PLAN NO. SDP 94-04(B) TO ALLOW as follows: WHEREAS, on December 3, 1997 the Carlsbad Planning Commissic held a duly noticed public hearing to consider a proposed Site Development Plan 1 the Seapointe Expansion, and adopted Resolution No. 4141 recommending to the C Council that the Site Development Plan be approved; and WHEREAS, the City Council of the City of Carlsbad, on 10th d; of February , 1998 held a public hearing to consider the recommendation ai heard all persons interested in or opposed to SDP 94-04(B); and WHEREAS, an Initial Study was prepared for the project and it w: determined that the project would not have a significant adverse effect on tk environment and a Negative Declaration was issued and approved by Plannir Commission Resolution No. 4136. NOW THEREFORE, BE IT RESOLVED by the City Council of the City Carlsbad, California, as follows: 1. That the recommendation of the Planning Commission for the approval Site Development Plan 94-04 is approved and that the findings a1 conditions of the Planning Commission contained in Planning Commissil Resolution No. 4141 on file with the City Clerk and incorporated herein reference, are the findings and conditions of the City Council. “NOTICE TO APPLICANT” “The time within which judicial review of this decision must be sought is govern1 by Code of Civil Procedure, Section 1094.6, which has been made applicable the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition other paper seeking judicial review must be filed in the appropriate court no la1 than the ninetieth day following the date on which this decision becomes fin’ however, if within ten days after the decision becomes final a request for tl record of proceedings accompanied by the required deposit in an amoL sufficient to cover the estimated cost of preparation of such record, the tin within which such petition may be filed in court is extended to not latter than tl thirtieth day following the date on which the record is either personally deliverc or mailed to the party, or his attorney of record, if he has one.
