RESOLUTION NO. 98-44
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A NEGATIVE
DECLARATION, ZONE CODE AMENDMENT AND LOCAL
COASTAL PROGRAM AMENDMENT, TO AMEND TITLE
21, CHAPTERS 21.95 AND 21.53 OF THE CARLSBAD
MUNICIPAL CODE TO STREAMLINE THE HILLSIDE
DEVELOPMENT PERMIT PROCESS, CLARIFY AND
SIMPLIFY THE ORDINANCE TO MAKE IT MORE USER
FRIENDLY AND ADD NEW DEVELOPMENT STANDARDS
TO ADDRESS ORDINANCE ISSUE AREAS.

The City Council of the City of Carlsbad, California, does hereby reso
as follows:
WHEREAS, the Planning Commission did on January 7, 1998, hold a d
noticed public hearing as prescribed by law to consider the Negative Declaration, Zc
Code Amendment 96-04 and Local Coastal Program Amendment 96-01 and adopi
Planning Commission Resolutions No. 3939, 3940 and 3941 recommending to the C
Council that they be approved; and
WHEREAS, the City Council did on the 17th day of February 15
hold a duly noticed public hearing as prescribed by law to consider the Negat
Declaration and proposed amendment to the Zoning Ordinance and Local Coa:
Program; and
WHEREAS, at said public hearing, upon hearing and considering
testimony and arguments, if any, of all persons desiring to be heard, the City Cou
considered all factors relating to the Negative Declaration, Zone Code Amendment 2
Local Coastal Program Amendment.

1. That the above recitations are true and correct.
2. That the findings of the Planning Commission in Resolution NI
3939, 3940 and 3941 constitute the findings of the City Council
this matter.
3. That the Negative Declaration, Zone Code Amendment and Lo
Coastal Program Amendment, ZCA 96-04 and LCPA 96-
respectively, are approved as shown in Planning Commiss!
