WHEREAS, the City has received a conditional Notice of Intent to issue permits from th California Coastal Commission; and WHEREAS, the Army Corps of Engineers will not consider their application complete un the Coastal Development Permit is issued; and WHEREAS, a requirement of the Coastal Permit is the recordation of restrictions in tl- form of an Irrevocable Offer of Dedication for Open Space or a Deed Restriction; and WHEREAS, construction of Cannon Road cannot begin until all permits are issued; and WHEREAS, construction windows are limited due to the proximity to endangered specie? and WHEREAS, the City Council can authorize the City Manager with City Attorney approv; to execute said documents; and WHEREAS, this action will expedite receiving the permit and executing document required by the permits; and WHEREAS, execution of documents complying with the terms and conditions of th. Resource Agency permits is in prior compliance with the certified environmental studies. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbaci California, as follows: 1.
