HomeMy WebLinkAbout1998-03-03; City Council; Resolution 98-52%$ e 0 RESOLUTION NO. 98-52 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A TENTATIVE MAP AND PLANNED DEVELOPMENT PERMIT TO SUBDIVIDE THE PROPERTY INTO 210 LOTS TO INCLUDE 4 MULTI FAMILY LOTS, 114 DUPLEX LOTS, 87 SINGLE FAMILY LOTS AND 5 OPEN SPACE LOTS ALL ON PROPERTY GENERALLY LOCATED ON THE SOUTHEAST CORNER OF PALOMAR AIRPORT ROAD AND MELROSE DRIVE, NORTH OF FUTURE POINSETTIA LANE, AND EAST OF BRESSI RANCH. CASENAME: RANCHO CARFULLO VILLAGES A, B, C, AND D CASE NO.: CT 97-021PUD 97-02 WHEREAS, the Planning Commission did on February 4, 1998, hold a dc noticed public hearing as prescribed by law to consider a Tentative Tract Map and Plann Development Permit (Rancho Carrillo Villages A, B, C, and D, CT 97-02 and PUD 97-02) ; an WHEREAS, the City Council of the City of Carlsbad, on the 3rd day March , 1998, held a duly noticed public hearing to consider said Tentative Tr: Map and Planned Development Permit and at that time received the recommendatio~ objections, protests, comments of all persons interested in or opposed to CT 97-02 and PUD 5 02; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the City Council ADOPTS Resolution No. 98-52 a determines that the findings and conditions as set forth in Planning Commission Resolutions P 424 1, and 4242 on file with the City Clerk and incorporated herein by reference, are the findir and conditions of the City Council. 3. That the applications for a Tentative Map and Planned Developm Permit to allow the subdivision of property into 210 lots all on property located on the southe corner of Palomar Airport Road and Melrose Drive, in LFMP Zone 18, is approved as shown Planning Commission Resolutions No. 4241 and 4242, on file with the City Clerk 2 incorporated herein by reference. c - ** . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e 0 4. This action is final the date this resolution is adopted by the City Counc The Provisions of Chapter 1.16 of the Carlsbad Municipal Code, “Time Limits for Judic: Review” shall apply: “NOTICE TO APPLICANT” “The time within which judicial review of this decision must be sought governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in t City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seekil review must be filed in the appropriate court not later than the nineteenth day following the de on which this decision becomes final; however, if within ten days after the decision becom final a request for the record of the deposit in an amount sufficient to cover the estimated cost preparation of such record, the time within which such petition may be filed in court is extend to not later than the thirtieth day following the date on which the record is either personal delivered or mailed to the party, or his attorney of record, if he has one.
