HomeMy WebLinkAbout1998-05-12; City Council; Resolution 98-140-5 4 1 2 3 4 5 0 0 E3k!BBp 2 RESOLUTION NO. 98-140 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AUTHORIZING THE EXECUTION OF CONTRACT NO. 351 1 FOR THE CONSTRUCTION OF THE BEACH ACCESS STAIR RECONSTRUCTION. I WHEREAS, plans have been reviewed by the City Council of the City of Carlsbad for thc ' 11 construction of the Beach Access Stair Reconstruction, Project No. 351 1; and 7 II WHEREAS, bids have been received by the City of Carlsbad for the construction of saic 8 )I project; and 9 WHEREAS, the low bid received to construct said project was submitted by Sean Male1 10 Engineering and Construction, Inc., in the amount of $91,467; and 11 WHEREAS, the low and second lowest bid received to construct said project submittec 12 by Sean Malek Engineering and Construction, Inc., and Wakeham-Baker, Inc., are responsive 13 and WHEREAS, the total estimated costs for said project if performed by Sean Male1 14 11 Engineering and Construction, Inc., are $156,807 and if performed by Wakeham-Baker, Inc., arc 15 $1 74,532; and 16 WHEREAS, Council has previously appropriated $1 81,900 for design, construction l7 /I administration and inspection of said Project; and WHEREAS, rapid progress in completing the work is highly desirable; and WHEREAS, City Council finds that failure by the low bidder to provide the requestel ecuted contract, bonds, and insurance and to begin work within twenty days is sufficient to fin1 ow bidder in default. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbac ifornia, as follows: 1. That the above recitations are true and correct. 2. That the bid of $91,467 by Sean Malek Engineering and Construction, Inc., fc ect No. 351 1 for the construction of the Beach Access Stair Reconstruction is accepted, an Mayor is hereby authorized to execute a contract therefor. ”* 0 0 1 3. That the bid of $105,102 by Wakeham-Baker, Inc., for Project No. 351 1 for thc 2 3 construction of the Beach Access Stair Reconstruction is accepted, contingent on the failure c Sean Malek Engineering and Construction, Inc., to provide executed contract document: suitable bonds and proof of insurance to the City Purchasing Officer within twenty days from thl award. For good cause shown, the City Manager may grant reasonable extension of this timi period. The Mayor is hereby authorized to execute a contract therefor under said contingency. 4 5 6 4. That in the event Sean Malek Engineering and Construction, Inc., be found i 7 default and a contract is executed with Wakeham-Baker, Inc., for construction of Project Nc 8 9 351 1 for the construction of the Beach Access Stair Reconstruction, staff is authorized to see pay the difference in construction cost. 10 bid bond funds from the bonding company of Sean Malek Engineering and Construction, Inc., ti 11 5.
