HomeMy WebLinkAbout1998-05-19; City Council; Resolution 98-14811 * I1 0 0 8, 1 2 3 4 5 6 7 8 9 10 11 12 RESOLUTION NO. 98-148 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE MAYOR TO EXECUTE A RATIFICATION OF EXTENSION AND AMENDMENT NO. 3 WITH TRANSTECH ENGINEERS, INC., FOR THE CONTINUED DEVELOPMENT OF THE COASTAL RAIL TRAIL PROJECT. WHEREAS, the City of Carlsbad has been designated as the lead agency coordinatin! the efforts to develop a comprehensive feasibility study and preliminary design plans for thc Coastal Rail Trail project; and WHEREAS, the City of Carlsbad entered into a Supplemental Agreement wit CALTRANS authorizing the use of $960,000 in lntermodal Surface Transportation Efficiency A( (ISTEA) funds for the development of the Coastal Rail Trail project; and WHEREAS, an initial agreement, dated February 13, 1996 with Transtech Engineer: (1 Inc., identified a scope of work for the preparation of a feasibility report and preliminary desig 13 plans for the Coastal Rail Trail project; and 14 WHEREAS, Amendment No. 1 to agreement, dated April 1, 1996, included missin 15 language relating to Disadvantage Business Enterprises (DBE's) as required by Caltrans fc federally funded projects; and 16 17 WHEREAS, Contract Extension and Amendment No. 2, dated June 23, 1997, identified scope of work for the preparation of the Environmental AssessmentAnitial Study documents an ongoing project management for the Coastal Rail Trail project; and 18 19 20 WHEREAS, the parties to the aforementioned agreement and Extension an Amendment No. 2 desire to alter the scope of work to provide for additional archaeologic; surveys required by Caltrans and ongoing project management beyond previous contra1 obligations; and 21 22 23 24 25 WHEREAS, the initial agreement expired on February 13, 1998 and Transtech Engineer 26 Inc., continued to work on the needed services without benefit of agreement; and 27 I/ WHEREAS, the City and Transtech Engineers, Inc., desire to ratify the extension of tt- 28 term of the original agreement dated February 13, 1996 for a period of one (1) year ending c February 13,1999; and e a 0 1 WHEREAS, Transtech Engineers, Inc., has submitted a detailed scope of work and cos 2 (CEQA) and the National Environmental Policy Act (NEPA). 4 CALTRANS in order to comply with the provisions of the California Environmental Quality Ac 3 proposal for the completion of the necessary archaeological survey documents required b 5 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbac 6 7 California, as follows: 1. That the above recitations are true and correct. 8 2. The extension and amendment of the original agreement by Ratification c 9 Extension and Amendment No. 3 is ratified. 10 11 3. The term of the agreement shall end on February 13, 1999. 4. All other provisions of the agreement entered into on February 13, 199E 12 force and effect. 14 entered on June 23, 1997 by and between City and Transtech Engineers, Inc., shall remain in fu 13 Amendment No. 1 of agreement entered on April 1, 1996, and Extension and Amendment No. 15 5.
