HomeMy WebLinkAbout1998-06-09; City Council; Resolution 98-178.rc * 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 a 0 EXHIBIT 4 RESOLUTION NO. 98-178 RESOLUTlON OF THE CITY COUNCIL OF THE G\TY QF CARLSBAD, CALIFORNIA, APPROVING THE ENGINEER'S REPORT FOR THE PROCEEDINGS FOR THE ANNUAL LEVY OF ASSESSMENTS WITHIN A SPECIAL MAINTENANCE DISTRICT WHEREAS, the City Council of the City of Carlsbad, California, pursuant to the terms the Landscaping and Lighting Act of 1972, being Division 15, Part 2 of the Streets 2 Highways Code of the State of California, did by previous resolution initiate proceedings 2 ordered the preparation of an Engineer's Report for the annual levy of assessments withir special maintenance district, said special maintenance district known and designated as Strt Lighting and Landscaping District No. 1 (hereinafter referred to as the Maintenance Distric and, WHEREAS, there has now been presented to this City Council the Report as requil by said Division 15 of the Streets and Highways Code and as previously directed by resolutic and, WHEREAS, this City Council has now carefully examined and reviewed the Report presented, and is satisfied with each and all of the items and documents as set forth there and is satisfied that the assessments, on a preliminary basis, have been spread in accordar with the benefits received from the improvements to be maintained, as set forth in said Repori NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That the Report as presented consists of the following: A. Plans and specifications describing the general nature, location and extent of the improvements to be maintained. B. Estimate of cost, including the amount of the annual installment for the forthcoming fiscal year. C. Said Report, as presented, is hereby approved on a preliminary basis, and is ordered to be fi in the Office of the City Clerk as a permanent record and to remain open to public inspection. SECTION 3. That the City Clerk shall certify to the passage and adoption of this Resolutic and the minutes of this meeting shall so reflect the presentation of the Engineer's Report. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad C Council, held on the 9th day of June , 1998 by the following vote, to wit: AYES: Council Members Lewis, Finnila, Nygaard, Kulchin and Hall NOES: None A ABSENT: None ATTEST: (SEAL) I
