RESOLUTION NO. 98-270
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A MITIGATED
NEGATIVE DECLARATION, A GENERAL PLAN AMENDMENT
LAND USE DESIGNATIONS SHOWN ON THE GENERAL PLAN
AND ZONING MAPS TO EXPAND THE SIZE OF THE EXISTING
COMMERCIAL SITE AND TO BRING THE VARIOUS PARCELS
INTO CONSISTENCY WITH THE LAND USE ELEMENT OF THE
GENERAL PLAN AND ZONING MAP.

CASE NO.: GPA 97-02/ZC 97-02
The City Council of the City of Carlsbad, California, does hereby resolve
GPA 97-02, AND A ZONE CHANGE ZC 97-02 TO CHANGE
CENTER
follows:
WHEREAS, on June 17, 1998, the Planning Commission held a duly notic
public hearing to consider a Mitigated Negative Declaration, General Plan Amendment (GPA !
02), and Zone Change (ZC 97-02), all relating to the La Costa Lucky Sav-on Shopping Cen
Project. At the conclusion of the hearing the Commission adopted Resolutions No. 4308, 431
and 4310 recommending approval of the Mitigated Negative Declaration, GPA 97-02, and ,
97-02, and
WHEREAS, the City Council of the City of Carlsbad, on the 4'h day
Auqust, 1998, held a public hearing to consider the Commission's recommendations and hi
all persons interested in or opposed to the Mitigated Negative Declaration, General P
Amendment (GPA 97-02), and Zone Change (ZC 97-02), relating to the La Costa Lucky Sav
Shopping Center Project.
NOW, THEREFORE, BE IT HEARBY RESOLVED by the City Council of the (
of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the City Council adopts and incorporates the findings of Planning Commis:
Resolutions No. 4308, 4309, and 4310 in approving the Mitigated Negative Declaration, Genl
Plan Amendment (GPA 97-02), and Zone Change (ZC 97-02).
a) The City Council finds that the Mitigated Negative Declara
reflects the City Council's independent judgment.

b) Location and Custodian of Record of Proceedings. Pursuant
Public Resources Code section 21081.6(d), all the materials that constitute the administrat
record in this proceeding are in the custody of and can be found in the offices of the City Clc
and the Director of Planning in the City of Carlsbad. The administrative record includes, bu,
not limited to: the Mitigated Negative Declaration and all public comments thereon receib
during the public review period and responses thereto, and the proceedings of the Plann
Commission and the City Council thereon.
EFFECTIVE DATE: This resolution shall be effective thirty (30) d;
following the adoption by the City Council.
PASSED AND ADOPTED at a regular meeting of the City Council of the Cit)
Carlsbad on the 4th day of August 1998, by the following vote, to wit:
AYES: Council Members Finnila, Nygaard, Kulchin and Hall
NOES: Mayor Lewis
