A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, MAKING DECLARATION
REGARDING DISPOSITION OF SURPLUS CONSTRUCTION
FUNDS.
7 WHEREAS, the City Council of the City of Carlsbad, California, has conductc
proceedings and received certification of completion of construction for certain works
improvement in a special assessment district pursuant to the terms and provisions of tt
“Municipal improvement Act of 1913,” being Division 12 of the Streets and Highways Code of tt
State of California; said special assessment district known and designated as ASSESSMEb

DISTRICT NO. 95-1 (CARLSBAD RANCH) (hereinafter referred to as the “Assessment District
13 WHEREAS, after completion of the improvements and payment of all the claims from tt-
14
Fund, and this legislative body is desirous at this time to make the disposition of said surplus 2 15
Improvement Fund for said Assessment District, there remains a surplus in the lmproveme
so provided by Section 10427 of the Streets and Highways Code of the State of California. 16
17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbal
California, as follows: 18

SECTION 1. That the above recitals are ail true and correct.
SECTION 2. That the works of improvement, as set forth and described in th
20 Resolution of Intention for these proceedings, have been completed to the satisfaction of th
legislative body, and all payment has either been made or set aside for all existing or potenti 21
22 claims, costs and expenses.
23 SECTION 3. That all surplus monies, at this time remaining in the Improvement Func
24 shall be used in the following manner:
