RESOLUTION NO. 98-292
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE FORM OF
CERTAIN AGREEMENTS FOR ASSESSMENT DISTRICT
NO. 96-1 (RANCHO CARRILLO)
WHEREAS, the CITY COUNCIL of the CITY OF CARLSBAD, CALIFORNIA
6 conducting proceedings for the acquisition and construction of certain public improvements in a spe
7 assessment district pursuant to the terms and provisions of the “Municipal Improvement Act of 19
8
district known and designated as ASSESSMENT DISTRICT NO. 96-1 (RANCHO CARRILLO) 9
being Division 12 of the Streets and Highways Code of the State of California, said special assessn
10
issue bonds to finance the acquisition and construction of such improvements, such bonds to is 12
WHEREAS, this legislative body has previously declared in its Resolution of Intentior 11
“Assessment District”); and,
13
WHEREAS, at this time this legislative body desires to set forth the general terms 15
such Code (the “Bond Act”); and, 14
pursuant to the terms and provisions of the “Improvement Bond Act of 191 5”, being Division 1(

conditions relating to the authorization, issuance and administration of such bonds and assessme
and,

WHEREAS, there has been presented, considered and ready for approval the form of a Spel
Assessment District Disclosure Agreement and an Agreement for the Filing of Final Maps Wit
Assessment District No. 96-1 (Rancho Carrillo).
21 /I NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED, AND ORDER

AS FOLLOWS: RECITALS
SECTION 1. The above recitals are true and correct.
SECTION 2. The City Manager, the Finance Director, and such other official of the City 2
may be designated by the City Council, or any of them (each an “Authorized Officer”), are hereby
authorized and directed to execute and deliver the documents described in this Resolution with such
28 additions and changes as the Authorized Officer deems advisable. The approval of such additions or

changes shall be conclusively evidenced by the execution and delivery of such documents b
Authorized Officer, upon consultation with and review by the City Attorney.
SECTION 3. The form of the Special Assessment District Disclosure Agreement an(
Agreement for the Filing of Final Maps Within Assessment District No. 96-1 (Rancho Carrill'
hereby approved. The Authorized Officer is hereby authorized and directed to cause the same t'
completed and executed on behalf of the City, subject to Section 2 above.
