HomeMy WebLinkAbout1998-10-13; City Council; Resolution 98-339I -% 0 0 7 I 2 3 4 RESOLUTION NO. 98-339 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT FOR THE DEMOLITION OF THE SPLK PAVILION, PROJECT NO. 361 5. 5 WHEREAS, the City Council of the City of Carlsbad, California, has. determined it I 6 necessary, desirable, and in the public interest to demolish the Split Pavilion; and , 7 WHEREAS, three (3) sealed bids were received on September 21, 1998 for the project; ~ 8 and 9 WHEREAS, The City issued Addendum No. 1 to add 43 lineal feet of mow strip and 10 made minor modifications to the specifications; and 11 WHEREAS, the low bidder, Excavating Engineers Inc., had not acknowledged the receipt 12 of the addendum at bid time, and did not include a cost for the added bid item; and 13 WHEREAS, J. C. Baldwin Construction Company submitted the second lowest 14 responsible bid in the amount of $123,362; and 15 WHEREAS, an additional appropriation of $17,481 is required from the General Capital 16 Construction Fund. 17 2. That the plans, specifications, and contract documents are on file in the office of 20 1. That the above recitations are true and correct. 19 California, as follows: 18 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 21 the City Engineer. 22 3. That the low bid submitted by the Excavating Engineers, Inc., is hereby declared 23 non-responsive and rejected. 24 4. That the low bid submitted by J. C. Baldwin Construction Company in the amount 25 *' of $123,362 is hereby accepted and the Mayor is hereby authorized to execute a contract on behalf of the City for the Demolition of the Split Pavilion, Project No. 3615. 27 5. That the minor irregularities in the bid of J. C.Baldwin Construction Company, 28 regarding his insurance policies is hereby waived. That additional appropriation of $17,481 is hereby approved. 8. That the award of this contract is contingent upon the bidder submitting the lowest responsive bid executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution. The City Manager may grant reasonable extensions of time. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 13th day of October , 1998 by the following vote, to wit: AYES: Council Members Lewis, Finnila, Nygaard and Kulchin NOES: None ATTEST: (%x& 4.20" ALETHA L.
