RESOLUTION NO. 98-395
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AUTHORIZING THE EXECUTION OF CONTRACT NO. STS98003 FOR CURB GUTTER & SIDEWLAK REPLACEMENT
WHEREAS, bids have been received by the City of Carlsbad, California for Curb Gutter
& Sidewalk Replacement; Contract No. STS98003; and
WHEREAS, the lowest responsive bid received was submitted by Doug Kost
Konstruction in the amount of $63,679.27; and
WHEREAS, sufficient funds are available in the Major Street Maintenance budget; and
WHEREAS, the award of this contract is contingent upon the contractor executing the
required contract and submitting the required bonds and insurance policies, as described in the
contract, within twenty (20) days of adoption of this resolution. The City Manager may grant
reasonable extensions of time; and
WHEREAS, if the contractor fails to comply with the insurance and bonding
requirements in the prescribed time, the City Council authorizes an administrative award of this
contract to the second or third lowest bidder. The bid security of the lowest bidder may be
forfeited. On the failure of the second or third lowest bidder to whom this contract is awarded to
execute it, the bidder’s security may likewise be forfeited.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as

The above recitations are true and correct.
The bid of $63,679.27 by Doug Kost Konstruction. for Curb Gutter & Sidewalk
Replacement, Contract No. STS98003 is hereby accepted and the Mayor and the
City Clerk are hereby authorized to execute a contract thereof.
