RESOLUTION NO. 98-415
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CARLSBAD, CALIFORNIA,
APPROVING THE ACQUISITION OF LOT 96
TN THE CARLSBAD RESEARCH CENTER AND
APPROPRIATING FUNDS
WHEREAS, the City Council of the City of Carlsbad, California, has
previously adopted a park mitigation fee for industrial development in order to
provide a recreation area for the industrial-based population; and,
WHEREAS, The City Council has determined that the subject property
could provide for the recreational needs of the industrial based population; and,
WHEREAS, under Council direction, staff has negotiated the purchase
price of $1,565,000 for Lot 96 in the Carlsbad Research Center; and,
WHEREAS, the negotiations are now complete and the owners and City
staff are in agreement with the basic terms of the sale.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That the above recitations are he and correct.
2. That the purchase of Lot 96 in the Carlsbad Research Center from Real
Estate 2, LLC for a price of $1,565,000 is hereby approved.
3. That the Mayor and/or the City Manager, with the approval of the City
Attorney, is authorized to execute any and all documents necessary to
complete the purchase.
4. That $390,000 is hereby appropriated from the Industrial Zones Park
Fees to the project account.

PASSED, APPROVED, AND ADOPTED at a regular
meeting of the Carlsbad City Council held on the 15th day of
December , 1998 by the following vote, to wit:
AYES: Council Members Lewis, Hall, Finnila, Nygaard and
NOES: None
ABSENT: None
