HomeMy WebLinkAbout1998-12-15; City Council; Resolution 98-4175 L 0 e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. g8-4I7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, CERTIFYING AN ENVIRONMENTAL IMPACT REPORT, A STATEMENT OF OVERRIDING CONSIDERATIONS, APPROVING CANDIDATE FINDINGS OF FACT, THE MITIGATION MONITORING AND REPORTING PROGRAM, AND APPROVING A TENTATIVE TRACT MAP, A HILLSIDE DEVELOPMENT PERMIT, A PLANNED DEVELOPMENT PERMIT, AND A SPECIAL USE PERMIT FOR THE SHELLEY TRACT MAP LOCATED EAST OF RANCHO SANTA FE ROAD AND NORTH OF CALLE ACERVO IN LOCAL FACILITIES MANAGEMENT ZONE 11. CASE NAME: SHELLY TRACT MAP CASE NO.: E 1 R 90-06/CT90-03/HDP 90- 1 1 PUD 90-04/SUP90-04 The City Council of the City of Carlsbad, California, does hereby rf follows: WHEREAS, on October 7, 1998, the Carlsbad Planning Commission noticed public hearings to consider a proposed Environmental Impact Report (Ell Tentative Tract Map (CT 90-03), Hillside Development Permit (HDP 90-II), Development Permit (PUD 90-04), and Special Use Permit (SUP 90-04) fo development on 103.9 acres of land, adopted Planning Commission Resolutions through 4353, respectively, recommending to the City Council that they be approved ; WHEREAS, the City Council of the City of Carlsbad, on the 15th December , 1998 held a public hearing to consider the recommendations and persons interested in or opposed to EIR 90-061CT 90-031HDP 90-111PUD 90-04/S1 and WHEREAS, an Environmental Impact Report was prepared and submi State Clearinghouse and a Notice of Completion was filed, published, and mailed to rc agencies and interested parties providing a 45 day review period. All comments rea the review period are fully incorporated into the conditions of approval for the project conditions will be reviewed through a mitigation monitoring and reporting program set project. 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 11 NOW, THEREFORE, BE IT RESOLVED by the City Council of thl Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Environmental Impact Report (EIR 90-06) on the above rc project is certified and the Candidate Findings of Fact, Statement of Overriding Consic and the Mitigation Monitoring and Reporting Program are approved, and that the fin( conditions of the Planning Commission contained in Planning Commission Resol1 4349, on file with the City Clerk and incorporated herein by reference, are the finc conditions of the City Council. 3. That the City Council finds that the EIR, including areas of conc as biology, air quality, traffic, noise, hydrology, grading, schools and land use compi adequate and that public notification was in compliance with the California Envil Quality Act, State of California Planning and Zoning Law, and the Carlsbad Municil and is adequate. 4.
