HomeMy WebLinkAbout1999-01-12; City Council; Resolution 99-21-7 I! 1 2 3 4 5 6 7 a 9 10 11 12 13 14 0 0 RESOLUTION NO. 99-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA FOR APPROVAL AND EXECUTION OF UTILITY AGREEMENT WITH CALTRANS FOR CONSTRUCTION OF CANNON ROAD RECYCLED REACH SAH4, SOUTH AGUA HEDIONDA INTERCEPTOR AND 35821 ‘WATER TRANSMISSION MAIN, PROJECT NO. 88-602 AND SEWER PROJECT NO. 92-408, CITY PROJECT NOS. 35341 WHEREAS, in February, 1998, the State of California Department of Transpor (CALTRANS) awarded a contract to construct road improvements to Cannon Road 1 their right-of-way; and WHEREAS, plans and specifications for both the Cannon Road Recycled \ Transmission Main and Reach SAH4, South Agua Hedionda Interceptor Sewer have prepared by the Carlsbad engineering staff; and WHEREAS, the State of California Department of Transportation (CALTR prepared a Utility Agreement with the City of Carlsbad and the Carlsbad Municipal l 15 11 District to construct the recycled water and interceptor sewer pipelines projects by a 16 I/ the projects to their contractor’s work by change order; and I.7 I1 WHEREAS, the plans and specifications have been submitted to the Contraci 18 proposal; and 19 State of California Department of Transportation (CALTRANS) to obtain a change 20 WHEREAS, a change order in the amount of $1,005,887 for construction cost 21 the District share is $657,078 plus $65,000 in contingencies) submitted by the St, 22 $100,000 for contingencies (the City share is $349,027 plus $35,000 in contingencie 23 11 California Department of Transportation (CALTRANS) regarding the work and pro 24 25 cost amount are accepted, authorization is hereby granted by the City Council to entc Department of Transportation (CALTRANS) to construct the recycled water and inter’ 26 a Utility Agreement with the Carlsbad Municipal Water District and the State of Cal 27 11 sewer pipelines by change order with CALTRANS Contractor; and 28 . 0 0 WHEREAS, CALTRANS, the City of Carlsbad and Carlsbad Municipal Water D will enter into a three party contract for construction of the project by a Utility Agreemer NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carl: 1 2 3 4 California, as follows: 5; ll 1. That the above recitations are true and correct. - II 6 2. That the plans and specifications and cost estimate for the construction ( 7 SAH4 Interceptor Sewer of $405,000, submitted by the Carlsbad engineering staff whic 8 accepted. 9 on file with the Engineering Department are incorporated herein by reference an1 10 3. That the Utility Agreement between the City of Carlsbad, the Carl X’ 12 Municipal Water District, and the State of California Department of Transporl 13 (CALTRANS) regarding the work and proposed cost amount to construc 14 recycled water and interceptor sewer pipeline projects by adding the cost to 15 ll contractor’s work by change order be approved and the Mayor, as representati 16 the City of Carlsbad, is authorized and directed to execute the agreement. 17 PASSED, APPROVED AND ADOPTED at a regular meeting of the 18 I 1999 by the following vote to wit. l9 Council of the City of Carlsbad, California, held on 12th day of Januar 2o 1 AYES: Council Members Lewis, Hall, Finnila, Nygaard and Kulchj 21 22 23 24 25 26 27 28 NOES: None ABSENT: None ATTEST: 1; (SEAL)
