CASE NAME: KELLY RANCH VILLAGE “E” CASE NO.: CDP 96-1 3(A) The City Council of the City of Carlsbad, California, does hereby re: follows: WHEREAS, on December 2, 1998, the Planning Commission held a dul) public hearing to consider a Coastal Development Permit Amendment for grading dl winter grading season and adopted Planning Commission Resolution No. 4430 recoml to the City Council that the Coastal Development Permit be approved; and WHEREAS, the City Council of the City of Carlsbad, on the 26th day of January , 1999, held a duly noticed public hearing to consic recommendation and heard all persons interested in or opposed to CDP 96-13(A); and NOW THEREFORE, BE IT RESOLVED by the City Council of the Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the recommendation of the Planning Commission of Coastal I ment Permit CDP 96-13(A) is approved and that the findings and conditions of the I Commission contained in Planning Commission Resolution No. 4430 on file with the C and incorporated herein by reference, are the findings and conditions of the City Counci 3. This action is final the date this resolution is adopted by the City The provisions of Chapter 1 .I6 of the Carlsbad Municipal Code, “Time Limits for Review” shall apply: “NOTICE TO APPLICANT” “The time within which judicial review of this decision must be sought i governed by Code of Civil Procedure, Section 1094.6, which has bee made applicable in the City of Carlsbad by Carlsbad Municipal Cod Chapter 1.16.
