RESOLUTION NO. 99-62
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING QUITCLAIM DEEDS
FOR PORTIONS OF EXISTING OPEN SPACE EASEMENTS
ORIGINALLY DEDICATED TO THE CITY OF CARLSBAD AT
AVIARA PLANNING AREA 26 SOUTH UNIT 1.
WHEREAS, Taylor Woodrow Homes California Limited has submitted a reql
6 quitclaims for portions of existing open space easements originally dedicated to the
Carlsbad over a portion of Aviara Planning Area 26 South Unit 1; and 7
8 WHEREAS, the open space is not part of the City designated open space, dc
9 contain any habitat, and was not required by the Coastal Commission; and
10 WHEREAS, the quitclaims are necessary because the existing perimeter fencins
11
locations; and 12
rear of the residential lots have been installed slightly within the open space easemer
13 WHEREAS, the demolition and relocation of the fence at this time is not a rea!
option since these properties are already occupied; and, 14 11 WHEREAS, the City Council of the City of Carlsbad has determined it to be in thc
15
interest to quitclaim said portions of easements;
16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of CE
17 1 I California, as follows:
18 1. That the above recitations are true and correct.
19 2. That the 25 quitclaim deeds quitclaiming portions of the existing open
20
incorporated by this reference; are approved. 21

County Recorder of San Diego County, State of California.

PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
5 held on the 16th day of February , 1999 by the following vote, to wit:
6 AYES: Council Members Lewis, Hall, Nygaard and Kulchin
