RESOLUTION NO. 99-80
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA FOR APPROVAL AND
EXECUTION OF A QUITCLAIM DEED OF A WATER
PIPELINE EASEMENT OVER A PORTION OF LOT 7,
MARINERS POINT, CMWD PROJECT NO. 86-504
5 WHEREAS, Stephen D. Doan and Tahra D. Doan, owners of Lot 7, Mariners F
6 have submitted a request for approval and execution of a quitclaim deed of a portion
7 water pipeline easement granted to the City of Carlsbad by Final Order of Condemn:

9578777of Official Records, for a temporary water pipeline which crosses over a portil 9
Superior Court Case No. N69945, recorded November 15, 1996, as File No. 1
10 Lot 7, Mariners Point, CMWD Project No. 86-504, located between Lemon Leaf Drive
11 Aviara Parkway for pipeline purposes, and since the water pipeline was moved intc
l2 public right-of-way and will no longer be necessary, because the water pipeline
l3 // concurrently and adequately been provided for within the public right-of-way; and
14 11 WHEREAS, the financial segment of acquisition of the water pipeline easemer

not involve actual cash, but credits issued to the developer for road development purpc
and
WHEREAS, the City Council of the City of Carlsbad has determined it to be i
best interest of public relations to waive the homeowner’s reimbursement of costs fc
small portion of original easement requested and to quitclaim said easement; and
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carl:
as follows:

and will no longer be necessary, which is on file with the City Clerk and is incorporatl

1 3. That the Mayor is authorized to execute the quitclaim deed, and the City Cle

4 recorded in the Office of the County Recorder of San Diego County, State of California.
