RESOLUTION NO. 99-123
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A QUITCLAIM FOR A
COVENANT FOR EASEMENT RECORDED AS A CONDITION
OF APPROVAL OF ARROYO LA COSTA, CT 88-03, UNIT NO. 2
5 WHEREAS, Villages of La Costa Southwest has submitted a request for quitclaim

approval of Arroyo La Costa, CT 88-03, Unit No. 2 over Lot No. 479, in favor of Lot No. 48L
Covenant for Easement which was recorded as Document No. 1996-0636778 as a conditio1
Map 13386; and

WHEREAS, the City Engineer has approved a lot line adjustment between Lots 479
9
484 of Map No. 13386 which required a new Covenant for Easement; and
10 WHEREAS, a new Covenant for Easement has been recorded as Document No. I!
11 0388817 to comply with the adjusted lot lines between Lots 479 and 484; and
12
l3 purpose originally intended; and
WHEREAS, said original Covenant for Easement is no longer needed to serve
14 WHEREAS, the City Council of the City of Carlsbad has determined it to be in the PL
15 interest to quitclaim said Covenant for Easement.
16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlst
17 California, as follows:
1. That the above recitations are true and correct.
2. That the Quitclaim Deed quitclaiming the City's interest in a Covenant for Easen-

per Document No. 1996-0636778 which is on file with the City Clerk and is incorporated by

1 3. That the Mayor is authorized to execute the original Quitclaim Deed and the
2 Clerk is hereby authorized to cause the original Quitclaim Deed to be released to the prop

owner to be recorded in the office of the County Recorder of San Diego County, Statt
California.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Cok
held on the 13th day of April , 1999 by the following vote, to wit:
AYES: Council Members Lewis, Hall, Finnila, Nygaard and Kulchin
