RESOLUTION NO. 99-135
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS, APPROPRIATING AN
ADDITIONAL $7,000 FROM THE GENERAL FUND BALANCE, AND
AUTHORIZING THE EXECUTION OF CONTRACT NO. 3590 FOR
THE CONSTRUCTION OF ARENAL ROAD RECONSTRUCTION.
WHEREAS, the City Council of the City of Carlsbad has previously authorized
advertisement for bids for the construction of Arena1 Road Reconstruction, Project No. 3590; E
WHEREAS, the City Council does hereby find that the project is in conformance witt
8 City’s General Plan; and
9 WHEREAS, four (4) sealed bids have been received on March 4, 1999 by the Cil

the City Council does hereby find that the lowest responsible bidder, HT Development 12
WHEREAS, all bid documents received from all bidders have been reviewed in detail 11
Carlsbad for the construction of said project; and
13 Construction, Inc., did submit a bid in the amount of $91,922.65; and
WHEREAS, staffs review of the bid documents submitted by HT Development 14
Construction, Inc., revealed several math errors in the bid schedule and said errors v
deemed to be immaterial defects and do not provide an advantage to HT Development
Construction, Inc., over the other bidders, be vehicles for favoritism, affect the amount of

’7 // bid, influence potential bidders to refrain from bidding, or affect the ability to make
l8 comparisons; and

WHEREAS, the total estimated costs for said project is estimated to be $154,623; and
WHEREAS, the City Council of the City of Carlsbad has previously appropriated fund
21 the amount of $150,000 for design, construction, administration and inspection of said projl

23 WHEREAS, Subsection 3.28.172(~)(1) of the Carlsbad Municipal Code authorizes the (
Manager to approve change orders in the amount equal to the contingency set at the time of
award; and

25 WHEREAS, the City Council of the City of Carlsbad, California, hereby declare;
26 necessary, desirable, and in the public interest to construct the aforementioned project.

1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carls

California, as follows:
1. That the above recitations are true and correct.
2. That the bid of $91,922.65 as determined by the extension of the unit p~
submitted by HT Development and Construction, Inc., for Project No. 3590, for reconstructic
Arenal Road, is hereby accepted and the Mayor and City Clerk are hereby authorized

6 I I directed to execute a contract therefor.
7 3. That a construction contingency of $13,000 is hereby approved.
4. That the Council authorizes the appropriation of an additional $7,000 from 8
9 General Fund balance for the construction of Arenal Road Reconstruction.

11 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City COI
12 held on the 20 Way of April , 1999 by the following vote, to wit:
