RESOLUTION NO. 99-173
A RESOLUTION OF THE CITY COUNCIL OF CARLSBAD,
CALIFORNIA FOR APPROVAL AND EXECUTION OF A
QUITCLAIM DEED OF A WATER PIPELINE EASEMENT
OVER A PORTION OF LOT 17, CARLSBAD RANCH
UNITS 2 & 3, CARLSBAD TRACT 94-09, CMWD
PROJECT NO. 94-504
WHEREAS, Carlsbad Estate Holding, Inc., owner of Lot 17, Carlsbad Ranch Units

& 3, Carlsbad Tract 94-09, have submitted a request for approval and execution of
recorded as a Certificate of Compliance on March 3, 1998 as Document No. 1998-012530 9
quitclaim deed of a water line and access easement granted to the City of Carlsba
10 of Official Records over a portion of Lot 17, Carlsbad Ranch Units 2 & 3, Carlsbad Tract 9~
11 09, CMWD Project No. 94-504, located on the south east side of Cannon Road for pipelin
l2 purposes that no longer contains water system facilities and will no longer be necessap

since the water pipeline was relocated to the north along the westerly property line I
Cannon Road, and the water pipeline has concurrently and adequately been provided fo
l5 and a new easement has been granted within the new location; and

WHEREAS, the City Council of the City of Carlsbad, California has determined it I
be in the public interest to quitclaim said easement; and
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbac
California, as follows:
I. That the above recitations are true and correct.
2. That the Quitclaim Deed conveying a water line and access easement over
portion of Lot 17, Carlsbad Ranch Units 2 & 3, Carlsbad Tract 94-09, CMWD Project NI
94-504, located on the south east side of Cannon Road for pipeline purposes granted to tt
25 City of Carlsbad, no longer contains water system facilities and will no longer be necessa

the new location, which is on file with the City Clerk and is incorporated by this reference; i
approved.
3. That the Mayor is authorized to execute the quitclaim deed, and the City Clerk
hereby authorized to cause the original deed to be returned to the original owner, Carlts
Company, 5600 Avenida Encinas #loo, Carlsbad, California 92008, to be recorded in th
Office of the County Recorder of San Diego County, State of California.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council I
the City of Carlsbad, California held on the 18 th day of May
19 99 , by the following vote to wit:
