DETENTION BASIN PRELIMINARY DESIGN, PROJECT NO. 3338.
ENVIRONMENTAL STUDIES TO MELROSE DRIVE AND 4
CONSULTANT AGREEMENT WITH RICK ENGINEERING TO ADD
CARLSBAD, CALIFORNIA, APPROVING AMENDMENT NO. 2 TO
5 WHEREAS, the City Council on March IO, 1998 approved an agreement c
6 Rick Engineering Company for a preliminary alignment of Melrose Drive; and

8 and a cultural resources study; and
WHEREAS, the initial environmental study identified the need for a least Bell's vireo st
9 WHEREAS, these studies are an extension of work currently being performed
10 Rick Engineering or their subconsultants, making them uniquely qualified to perform
additional work. 11
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlst
12 California, as follows:
13 1. That the above recitations are true and correct.
14 2. That Amendment No. 2 to the consultant agreement with Rick Enginee
15
approved and the Mayor is hereby authorized and directed to execute said amendment.

AMENDMENT NO. 2 TO AGREEMENT
This Amendment is entered into and effective as of the 8 th day of
June , 1999, amending the agreement dated March 1 I , 1998 by and between the
City of Carlsbad, a municipal corporation, hereinafter referred to as tlCity"I and Rick Engineering
Company, hereinafter referred to as, "Contractor" for preliminary design, environmental, and
other services for Melrose Drive, Project No. 3598.
RECITALS

WHEREAS, a supplemental scope of work and fee schedule have been
negotiated and agreed to between the parties hereto, and as shown on Exhibit "A" Scope of
Services and Fee;
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein, City and Contractor hereby agree as follows:
1. Contractor shall provide services as outlined on the attached Exhibit "A".
2. City shall pay Contractor for all work associated with Paragraph 1 above,
on a time and materials basis not-to-exceed $19,911. Contractor shall provide City on a monthly
basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and
related activities and costs for approval by City.

3. Contractor shall complete all work outlined on the attached Exhibit “A” by
expiration of the agreement amended hereby.
4. All other provisions of the aforementioned agreement entered into on
March 1 I, 1998, by and between City and Contractor shall remain in full force and effect.
5. All requisite insurance policies to be maintained by the Contractor shall
include coverage for the amended assignment and scope of work.

Based upon your verbal authorization, we have begun the Least Bell Vireo Technical surveys. This
is because the survey season for this endangered species has already begun and therefore it is critical
to begin the survey as soon as possible. The cultural resource significance evaluations will require
a backhoe on the project site. Therefore, we will need permission from the property owner to enter
their property and perform the required environmental testing.
