CASE NAME: ENCINA EFFLUENT PUMP STATION CASE NO.: PDP 1 (EYCDP 98-82 The City Council of the City of Carlsbad, California, does hereby resolv follows: WHEREAS, pursuant to the provisions of the Municipal Code, the Plar Commission did, on April 21, 1999, hold a duly noticed public hearing as prescribed by la consider a Precise Development Plan Amendment and Coastal Development Permit; and WHEREAS, the City Council of the City of Carlsbad, on the 15 day of 3 1999, held a duly noticed public hearing to consider said Precise Development Amendment and Coastal Development Permit and at that time received the recommendat objections, protests, comments of all persons interested in or opposed to PDP I (E)/CDP 9e NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the City Council approves ENCINA EFFLUENT PUMP STATK PDP l(E)/CDP 98-82, and that the findings and conditions of the Planning Commission a$ forth in Planning Commission Resolutions No. 4544 and 4545, on file with the City Clerk made a part hereof by reference are the findings and conditions of the City Council. 3. This action is final the date this resolution is adopted by the City COL The Provisions of Chapter 1 .I6 of the Carlsbad Municipal Code, “Time Limits for Jud Review“ shall apply: “NOTICE TO APPLICANT” “The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16.
