RESOLUTION NO. 99-217
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A NEGATIVE
DECLARATION FOR ZCA 99-011LCPA 99-01 AND APPROVING
LCPA 99-01.
CASE NAME: INCIDENTAL OUTDOOR DINING AREAS II

The City Council of the City of Carlsbad, California, does hereby resoh
follows:
WHEREAS, on April 21, 1999, the Carlsbad Planning Commission held a
noticed public hearing to consider a Negative Declaration, Zone Code Amendment (ZCA 9'
and Local Coastal Program Amendment (LCPA 99-01) relating to Incidental Outdoor C
Areas II. At the conclusion of the hearing the Commission adopted Planning Commi
Resolutions No. 4482, 4483, and 4484 recommending approval of the Negative Declari
ZCA 99-01 and LCPA 99-01; and
WHEREAS, the City Council of the City of Carlsbad, on the 15 d
June , 1999, held a duly noticed public hearing to consider the Commiss
recommendations and to hear all persons interested in or opposed to the Negative Declar;
Zone Code Amendment (ZCA 99-01) and Local Coastal Program Amendment (LCPA 9!
relating to Incidental Outdoor Dining Areas II.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the
of Carlsbad, California as follows:
1. That the above recitations are true and correct.
2. That the City Council adopts and incorporates the findings of Plar
Commission Resolution No. 4482 approving the Negative Declaration for the Incidental Out
Dining Areas II Zone Code Amendment (ZCA 99-01) and Local Coastal Program Amendr
(LCPA 99-01 ).

a. Independent Judgment: The City Council finds that the Neg,
Declaration reflects the City Council's independent Judgement.
b. Location and Custodian of Record of Proceedings. Pursuar
Public Resources Code section 21081.6(d), all the materials
constitute the administrative record in this proceeding are in
custody of and can be found in the offices of the City Clerk an(
Director of Planning in the City of Carlsbad. The administr

record includes, but is not limited to: the Negative Declaration ar
public comments thereon received during the public review p
and responses thereto, and the proceedings of the Plat
Commission and the City Council thereon.
3. That the City Council adopts and incorporates the findings of Plat Commission Resolutions No. 4483 and 4484 recommending approval of Zone (
Amendment (ZCA 99-01) and Local Coastal Program Amendment (LCPA 99-01).
