A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

AGREEMENT WITH RECON ENVIRONMENTAL, INC., FOR
CARLSBAD, CALIFORNIA, APPROVING AMENDMENT NO. I TO
CONSTRUCTION MONITORING FOR FARADAY AVENUE,
PROJECT NO. 3593.

WHEREAS, the City Council of the City of Carlsbad, California, has determine(
necessary and in the public interest to approve and accept Amendment No. 1 to Agreement \i
RECON Environmental, Inc., (RECON) for construction monitoring for Faraday Avenue; and

WHEREAS, the City Council has determined that RECON is the best qualified firm 1
the professional skills necessary to perform the archaeological site data recovery effort i
prepare the technical report; and

WHEREAS, a mutually satisfactory fee for the services has been negotiated; and
12 11 WHEREAS, the City Council recognizes the need to have the data recovery effort and
13
associated technical report in compliance with the Cultural Resources Guidelines of the City; ar

WHEREAS, total project cost estimated for the data recovery effort is $93,524; and

WHEREAS, funds have been previously appropriated for Faraday Avenue and there
sufficient funds available for this project; and
WHEREAS, the Mayor is hereby authorized to execute the proposed Amendment Nc
to Agreement for Construction Monitoring for Faraday Avenue with RECON.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsb

AMENDMENT NO. I TO AGREEMENT FOR
CONSTRUCTION MONITORING FOR FARADAY AVENUE PROJECT NO. 3593
This Amendment is entered into and effective as of the 6 th day of
July , 1992, amending the agreement dated 3UW \ ; [q44 by and
between the City of Carlsbad, a municipal corporation, hereinafter referred to as "City", and
RECON Environmental, Inc. (RECON), a California corporation, hereinafter referred to as
"Contractor" for construction monitoring services for preparation of reports of permit compliance
and any required data recovery.
RECITALS
WHEREAS, the initial agreement, dated 3w \ ) \!q identified a
scope of work to provide the necessary construction monitoring services for preparation of
reports and permit compliance and required data recovery; and
WHEREAS, the parties to this aforementioned agreement desire to alter the
scope of work as follows: Preliminary testing of archaeological site CA-SDI-8303 has indicated
a data recovery program is required; and
WHEREAS, a supplemental scope of work and fee schedule have been
negotiated and agreed to between the parties hereto, and as shown on Exhibit 'W Scope of
Services and Fee;
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein, City and Contractor hereby agree as follows:
1. Contractor shall provide services as outlined on the attached Exhibit "B".
2. City shall pay Contractor for all work associated with Paragraph 1 above,
on a time and materials basis not-to-exceed $93,524. Contractor shall provide City on a
monthly basis, copies of invoices sufficiently detailed to include hours performed, hourly rates,
and related activities and costs for approval by City.

3. Contractor shall complete all work outlined on the attached Exhibit ll~rl by
September 1, 1999 or by expiration of the agreement amended hereby.
4. All other provisions of the aforementioned agreement entered into on
4WW 1 ! @!q , by and between City and Contractor shall remain in full force and effect.
5. All requisite insurance policies to be maintained by the Contractor shall
include coverage for the amended assignment and scope of work.

EXHIBIT "B"
DATA RECOVERY PLAN FOR A PORTION OF CA-SDI-8303
FARADAY AVENUE EXPANSION PROJECT
SCOPE OF WORK
Phase I:
Phase I will include hand excavation of a data recovery sample of thirty square meters of site deposit. These sample units will be distributed across the project area within the
defined limits of site deposit as defined by the Gallegos study. The units will be
organized around the productive sample units and shovel test pits from the Gallegos
significance evaluation. Specifically near Sample Unit 4A and Shovel Test Pits IOA,
1 IA, and 12A in the larger western site segment and in the vicinity of Sample Unit 3A in
the smaller eastern segment. A combination of single and clustered unit arrangements will be used to maximize the sample coverage. A total of three radiocarbon samples will be submitted from sample units completed during this first phase. Based on a visual and initial cataloging impression of the materials recovered from the first phase of
sample units, we may recommend the need for a second phase of up to twenty square
meters of additional sample.
I. Survey and layout grid for the Phase I data recovery effort.
2. Excavate up to thirty square meters of archaeological deposit.
3. Clean, sort, and analyze the recovered archaeological sample.
4. Submit up to three samples for radiocarbon analysis.
5. Provide a summary of results to City staff for determination of the requirement of
Phase II.
Phase II (if required):
Phase II would be implemented in the event that buried features, including human
burials were uncovered, which would require additional exploration, or in the event that
the first phase of sample units revealed activity foci or other unusual site elements that
would benefit from additional sampling. The decision to conduct Phase II would be made in consultation with City or Carlsbad staff.
I. Excavate up to twenty square meters of archaeological deposit.
2. Clean, sort, and analyze the recovered archaeological sample.
3. Submit up to two samples for radiocarbon analysis.

Phase 111:
Phase Ill of work will include the controlled destruction of the portions of CA-SDl-8303
that are within the project APE. Under the direction of the project archaeologist a
front-end loader will be used to remove site sediments in a controlled and careful
manner. Archaeological monitors will be present during this phase to collect diagnostic
artifacts and to divert the grading equipment if buried features are uncovered. This phase would replace the need for construction monitoring as all of the site soil within
the APE would be removed during this phase of work. Staking will be used to define the
limits of grading and areas outside the staking will be off-limits to construction vehicles
and activity.
1. Provide equipment and direct controlled removal of archaeological deposit.
2. Provide a qualified archaeological monitor during the removal process.
3. Collect diagnostic artifacts and record uncovered features.
4. Prepare a final technical report providing methods and results of all completed
phases for clients use.
