RESOLUTION NO. 99-445
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE FINAL MAP FOR
SUBDIVISION AND AUTHORIZING THE CITY CLERK TO
PROCESS THE MAP FOR RECORDING.
PHASE I OF CARLSBAD TRACT CT 97-23, MAGNOLIA
I WHEREAS, Mike O'Gara has submitted a final map known as Carlsbad Tract CT 97 ' 1 I Magnolia Subdivision to the City of Carlsbad for approval; and
7 /I WHEREAS, the tentative map of Carlsbad Tract CT 97-23, Magnolia Subdivision

conditions, was approved by the Planning Commission on July 1 , 1998, pursuant to Resolu
No. 4283 - 4285; and
10 WHEREAS, the Public Works Director has determined that said map substant
11 conforms to said conditionally approved tentative map; and
12 WHEREAS, the conditions of approval for said final map have been completec
13 11 secured; and
WHEREAS, the developer has offered public easements for dedication to the Cit 14
Carlsbad; and
15 WHEREAS, the final map conforms to the City of Carlsbad General Plan and
16 requirements of City Codes and Standards; and
17 WHEREAS, the City Council of the City of Carlsbad determined it to be in the pi
l8 interest to approve said final map; and
19 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlst
20 California, as follows:
21 1. That the above recitations are true and correct.
22 2. That said final map known as Carlsbad Tract CT 97-23, Magnolia Subdivis
which is on file with the Public Works Director and is incorporated herein by referencc 23 11 accepted. 24
3. That the City accepts the dedications shown on the final map.
4. That the City Clerk is authorized to sign the Certificate of Acceptance on the 1 25
26 map.
27 5. That the City Clerk is authorized to cause the original final map to be recorde
28 the Office of the County Recorder of San Diego County, State of California.

3 6. That the City Clerk is authorized to release the map to Chicago Title for recon
in the Office of the County Recorder. 4
5 PASSED, APPROVED AND ADOPTED at a regular meeting of the Ca~khad City COL
6 held on the 5th day of Oct-,hey , 1999 by the following vote, to wit:
7 AYES: Council Members Lewis, Nygaard, Finnila & Hall
8 NOES: None
9 ABSENT: Councl Member Kul
