RESOLUTION NO. 99-469
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE MEMORANDUM OF
UNDERSTANDING FOR THE SRO PROGRAM BETWEEN THE
CITY OF CARLSBAD AND CARLSBAD UNIFIED SCHOOL
DISTRICT
WHEREAS, the City Council of the City of Carlsbad, California, finds that it would
mutually beneficial for the City and the Carlsbad Unified School District to share costs of

School Resource Officer Program; and
NOW, THEREFORE, the City Council of the City of Carlsbad does hereby resolve
follows:
1. That the Memorandum of Understanding for the SRO Program, attached hereto
Exhibit 2, between the City of Carlsbad and Carlsbad Unified School District is her
approved.

MEMORANDUM OF UNDERSTANDING
BETWEEN
CARLSBAD UNIFIED SCHOOL DISTRICT
AND
CITY OF CARLSBAD
MISSION STATEMENT It is the mission of the Carlsbad Police Department in
concert with the Carlsbad Unified School District to provide a safe, secure,
peaceful teaching and learning environment for all students and staff within
the City of Carlsbad by protecting life and property.
Ensuring the safety of students and staff on school campuses in Carlsbad is a
priority to the school administration and the police department. Campus
security will be increased by the presence of police officers who will interact
with the students in both a positive and proactive manner. Police officers on
campus will help improve relations between the police department and the
youth of the community. Therefore, the Carlsbad Unified School District and
the City of Carlsbad have the following expectations and agree to undertake the
listed responsibilities to achieve these mutual objectives:
A. SCHOOL DISTRICT’S ROLE AND RESPONSIBILITY
1. To ensure student welfare portal to portal;
2. To develop procedures to handle campus safety issues;
3. To establish and follow procedures for referring police involvement;
and
4. To cooperate with and support in a proactive manner the City of
Carlsbad Police Department to ensure the success of programs
involving students, school personnel, parents and the community.
B. SCHOOL RESOURCE OFFICER’S ROLE AND RESPONSIBILITY
1. To provide prevention/ intervention by:
To provide high visibility of uniform police officer presence on the
campus of the Carlsbad High School located in the City of
Carlsbad.
0 Developing classroom and faculty presentations relating to the
youth and the law;
Attending parent conferences/ meetings;

Attending S.A.R.B. (Student Attendance Review Board) and
meetings;
Scheduling security activities as needed;
Be the first response in all law enforcement related matters as they
occur during regular school hours;
To attend various sporting events and school activities as needed
for proactive enforcement and interaction; and
To document all incidents of crime as per department regulations.
2. To continue to work with:
Community agencies; and
Parent/teacher groups as needed throughout the school.
3. To assist investigative personnel of the Carlsbad Police Department,
San Diego County Sheriffs Department and other law enforcement
agencies who are assigned to any ongoing investigation and/or
preliminary investigation of criminal activity within the school.
4. To work with school staff and district personnel in the matter of
mutual concern such as:
Alcohol and drug use on campus;
Safety of students and staff on campus;
Gang-related violence and crime;
0 Campus intrusion; and
0 Loss and/or damage to property.
C. TERM OF AGREEMENT
This Memorandum of Understanding shall remain in effect for the 1999-
2000 public school fiscal year, and may be extended for such length of
time as both parties mutually agree to continue this Memorandum of
Understanding. The City Manager shall have the authority to execute

extension of this Memorandum of Understanding on behalf of the City.
However, either party shall have the right to cancel this Memorandum of
Understanding upon 90 days advance written notice during the term of
this agreement.
D. SPAN OF CONTROL/ JURISDICTION
One full-time police officer will be assigned to provide the School Resource
Program to Carlsbad High School.
Prevention/education/ training/ proactive activities will take place at
Carlsbad High School and at public meeting places within the community
as it relates to the Carlsbad Unified School District activities.
The officer will remain under the direction and control of the Carlsbad
Police Department. Requests for work assignments will be issued from the
superintendent/principal’s office to the training sergeant of the Carlsbad
Police Department, who will thereafter direct the school resource officer to
respond appropriately to the request.
E. RESOURCE
Resource and local management will be coordinated at:
Carlsbad Unified School District, 801 Pine Avenue, Carlsbad, California,

City of Carlsbad Police Department, 2560 Orion Way, Carlsbad, Carlsbad,

F. COST
Cost sharing will be based upon the services of one full-time police officer
for nine months of the school year. The portion funded by the District will
be prorated based upon the school year (nine months) at a rate of one half
of total compensation of one full-time sworn police officer. Total
compensation includes salary, estimated overtime and benefits. See
Exhibit A for details.
This Memorandum of Understanding will be effective July 1, 1999, and the
Carlsbad Unified School District will pay annually, upon execution of this
Memorandum, to the Finance Director of the City of Carlsbad the agreed
amount as outlined in Exhibit A. If the agreement is canceled as herein
permitted, City shall forthwith return to the District the portion of such

payment allocable to the period of the term subsequent to the effective
date of cancellation.
G. NO INDEPENDENT BASIS FOR LIABILITY
Nothing herein shall create, by this or other understanding between the
parties, an independent basis for liability of the City to either the District
or to a third party for failing to respond or for responding to a call for
police services in a dilatory or negligent manner. The City’s liability, if
any, shall be determined by law without regard to the existence of this
Agreement.
