HomeMy WebLinkAbout1999-12-14; City Council; Resolution 99-5321 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I 1 I 0 e RESOLUTION NO. 99-532 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING A REQUEST FOR AN PROHIBITING THE ISSUANCE OF GRADING AND/OR BUILDING PERMITS FOR PROJECTS PROCESSED UNDER TITLE 20 AND 21 OF THE CARLSBAD MUNICIPAL CODE IN THE AREA KNOWN AS “OLDE CARLSBAD” CASE NAME: MAGNOLIA GARDENS CASE NO.: CT 98-1 2/SDP 98-22 The City Council of the City of Carlsbad, California, does hereby resolvt EXEMPTION FROM THE URGENCY ORDINANCE (NS-516) follows: WHEREAS, on November 2, 1999, the City Council took action to ado1 urgency ordinance establishing a moratorium on the issuance of grading and/or building pe for all projects processed under Title 20 and 21 of the Carlsbad Municipal Code and lo( within the area known as “Olde Carlsbad”; WHEREAS, the urgency ordinance included a process whereby the pr applicant could be granted an exemption from the moratorium upon written request fron applicant and/or property owner; and WHEREAS, a written request has been submitted for the project know1 Magnolia Gardens - CT 98-1 ZSDP 98-22; and WHEREAS, on December 14, 1999 the City Council considered said reques information provided by the applicant and/or property owners as well as any other inter€ persons providing testimony. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commis of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That the City Council DENIES the request for the following reasons: I. The project includes more street improvements than just a small intervening i between properties with existing improvements where there are very limited option regard to the appropriate type of street improvements which should be constructed. 2.
