A RESOLUTION OF THE CITY OF CARLSBAD CITY COUNCIL, FOR
ENCINA BASIN WATER RECLAMATION PROGRAM, PHASE I1
APPROVAL OF A MITIGATED NEGATIVE DECLARATION FOR THE
PROJECT, CASE NO. EIA 99-09; CMWD PROJECT NO. 98-301. 6
7 WHEREAS, City of Carlsbad, "Developer" and 'Owner", has filed a verif
8 application with the City of Carlsbad regarding property City-wide ("the Propert)
9 and
10 WHEREAS, a Negative Declaration was prepared in conjunction with s
11 project; and
12 WHEREAS, the City Council did on the 18th of January, 2000, hold a d
13 noticed public hearing as prescribed by law to consider said request; and
14 WHEREAS, at said public hearing, upon hearing and considering all testimc
15
staff, and considering any written comments received, the City Council conside 16
and arguments, examining the initial study, analyzing the information submitted
all factors relating to the Negative Declaration; and 17
18 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
19 Carlsbad, California, as follows:
20 1. That the above recitations are true and correct.

2. That based on the evidence presented at the public hearing, the Cit)
Council hereby approves the Mitigated Negative Declaration according
23 Exhibit 'ND" dated December 10, 1999, and "PII" dated December
1999, on file with the City Clerk and made a part hereof, based on
following findings:

0 The City Council has reviewed, analyzed and considered the Mitigz
27 Negative Declaration, the environmental impacts therein identified for
project and any comments thereon prior to APPROVAL of the project. 28

requirements of the California Environmental Quality Act, the St
Guidelines and the Environmental Protection Procedures of the City
Carlsbad.
0 The Mitigated Negative Declaration reflects the independent judgment
the City Council of the City of Carlsbad.
0 Based on the EIA Part I1 and comments thereon, there is no substan
evidence the project will have a significant effect on the environment.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad (
Council held on the 25th day of January , 2000 by the follow
vote, to wit:
