RESOLUTION NO. 30-1 14
A RESOLUTION OF THE CITY COUMCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEiPTING BIDS AND
AUTHORIZING THE EXECUTION OF CONTRACT NO. STS99-
00-01FOR CURB GUTTER & SIDEWALK REPLACEMENT

Sidewalk Replacement Contract No. STS99-00-01; and, 6
WHEREAS, bids have been received by the City of Carlsbad, California for Curb Guttc
7 WHEREAS, the lowest responsive bid received was submitted by Bighorn Construc
8 Company Inc. in the amount of $84,811.50; and,
WHEREAS, sufficient funds are available in the Major Street Maintenance budget (8C
9
and Transnet Local Sidewalk Construction Project No. 6 (20%); and
10 WHEREAS, the award of this contract is contingent upon the contractor executing
I’ 11 required contract and submitting the required bonds and insurance policies, as described in

reasonable extensions of time; and, l3
contract, within twenty days of adoption of this resolution. The City Manager may gr
14 WHEREAS, if the contractor fails to comply with the insurance and bonding requireme
15 in the prescribed time, the City Council authorizes an administrative award of this contract to
16 second ‘or third lowest bidder. The bid security of the lowest bidder may be forfeited. On i
failure of the second or third lowest bidder to whom this contract is awarded to execute it, i
bidder’s security may likewise be forfeited.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsb; 19
California, as follows:

21 1. The above recitations are true and correct.
2. The bid of $84,811.50 by Bighorn Construction Company Inc. for Curb Gutter
Sidewalk Replacement, Contract No. STS99-00-01 is hereby accepted and the Ma,
and City Clerk are hereby authorized to execute a contract thereof.

3. The Purchasing Officer is hereby authorized and directed to issue a purchase ordel
this contractor.
