A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, FOR APPROVAL OF CONTRACT WITH
MALCOLM-PIRNIE, INC., TO PROVIDE CONSTRUCTION
ASSISTANCE SERVICES FOR VISTAKARLSBAD INTERCEPTOR
SEWER REACHES VCSB THROUGH VC1 lA, CMWD PROJECT NO.
91-403, PROJECT NO. 3182, SOUTH CARLSBAD VILLAGE STORM
DRAIN, PROJECT NO. 3528, AND PAVEMENT OVERLAY,
PROJECT NO. 3667.
7 WHEREAS, a Request for Proposal was requested and received to provide construction

assistance services for the Vista/Carlsbad Interceptor Sewer Replacement and the South
Carlsbad Village Storm Drain; and
IO WHEREAS, the City Council of the City of Carlsbad, California, has determined it
11 necessary and in the public interest for approval and acceptance of an agreement with
12
13
Malcolm-Pirnie, Inc., for construction assistance services for this project based upon their
familiarity with the project and their excellent qualifications; and
WHEREAS, appropriated funds in the amount of $22,272,418 are available for
14
15

construction of the projects and the cost for construction assistance services for the projects is
$245,924, therefore there are sufficient funds available for this project; and
WHEREAS, the project costs associated with the Interceptor Sewer are jointly shared with I
17 the City of Vista in accordance with the joint ownership agreement dated July 18, 1966.
18 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
19 California, as follows:
1. That the above recitations are true and correct. 20
21 2. That the attached agreement between Malcolm-Pirnie, Inc., and the City of
Carlsbad to provide construction assistance services for the VistaKarlsbad Interceptor Sewer
22 ~ Replacement Project, Reaches VCSB to VC1 lA, the Chestnut Collector Sewer and the South
23 Carlsbad Village Storm Drain Projects be approved and accepted.

1 3. That the Mayor is authorized and directed to execute the proposed agreement
2 between Malcolm-Pirnie, Inc., and the City of Carlsbad.

4 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 26th day of September , 2000 by the following vote, to wit: 5
