HomeMy WebLinkAbout2001-02-13; City Council; Resolution 2001-471 2 3 4 5 6 7 8 9 10 11 12 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2o01-47 A RESOLUTION OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING RULES AND REGULATIONS FOR IMPLEMENTATION OF THE CALIFORNIA PF~XAT~ClNASSISTAN~FI4W WHEREAS, the City Council of the City of Carlsbad is required by Government Code section 7267.8 to adopt rules and regulations to implement State relocation requirements found in 25 California Code of Regulations, sections 6000 et. seq., which may be triggered by City acquisition activities; and WHEREAS, it is desirable that the City of Carlsbad have the same rules applicable to its acquisition of real property and displacement activities as the City’s subsidiary water district and the Redevelopment Agency; and WHEREAS, Health and Safety Code section 33417.5 creates a Redevelopment Agency Relocation Appeals Board by operation of law, and WHEREAS, Government Code section 7266 authorizes a City Council by Ordinance to designate the Redevelopment Agency Relocation Appeals Board as the Relocation Appeals Board for the City and all public entities within the City other than State agencies; and WHEREAS, the City Council by companion ordinance has established the Housing Commission as the Relocation Appeals Board for itself, the water district, and the Redevelopment Agency; and WHEREAS, Government Code section 7267 exempts from the acquisition regulations the acquisition of any easement, right-of-way, covenant or other non- possessory interest in real property to be acquired for the construction, reconstruction, alteration, enlargement, maintenance, renewal, repair, or replacement of subsurface 3 1 2 3 4 5 6 7 8 9 10 11 12 18 19 20 21 22 23 24 25 26 27 28 Sewers, waterlines or appurtenances, drains, septic tanks, or stormwater drains. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the City of Carlsbad Rules and Regulations for Implementation of the California Relocation Assistance Law on file in the Office of the City Clerk and incorporated by this reference, are hereby adopted. 3. That the Housing Commission shall be the Relocation Appeals Board. PASSED, APPROVED AND ADOPTED at a Regular Meeting of the Carlsbad City Council held on this 13th day of February , 2001, by the following vote, to wit: AYES: Council Members Lewis, Kulchin, F innila, Nygaard and Hall.
