2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE
3 SETTLEMENT OF THE LAWSUIT ENTITLED SIERRA
4 PACIFIC EARTH RETENTION CORP. V. TAYLOR BALL OF
CALIFORNIA, INC., CASE NO. N81303
5 WHEREAS, upon recommendation of the City Attorney, the City Council
6 of the City of Carlsbad, California has determined that a settlement in the case entitled
7
8 Sierra Pacific Earth Retention Corp. v. Taylor Ball of California, Inc. is in the public
9 interest; and
10 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
11 Carlsbad, California, as follows:
12 9 3 1. That the above recitations are true and correct. mwm Yr7 13 g pR 2. That the City Council approves the settlement and authorizes the

22; Mayor to sign the Settlement Agreement, which is hereby approved. 9 15 si$$j
