HomeMy WebLinkAbout2001-06-05; City Council; Resolution 2001-155RESOLUTION NO. 2001-155 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, SUMMARILY VACATING PORTIONS 3 OF PINE AVENUE AND LINCOLN STREET, STV 00-01. 4 II WHEREAS, a request has been made to vacate portions of Pine Avenue and Lincoln 5’ Street; and 6 WHEREAS, Pine Avenue and Lincoln Street are designated as local streets which 7 requires a right-of-way width of 60 feet; and 8 9 WHEREAS, Pine Avenue and Lincoln Street presently has a right-of-way width of 80-feet along the portion of the street proposed to be vacated; and 10 WHEREAS, the City Engineer has determined that the excess right-of-way is not required 12 13 14 15 16 17 WHEREAS, the vacation of this excess right-of-way will result in approximately 1,614 square feet of land being returned to the tax rolls; and WHEREAS, public utility agencies were notified of the proposed street vacation. As a result of the notification, one public utility agency requested reservation of a utility easement for continued maintenance of existing overhead facilities; and 18 WHEREAS, the excess right-of-way provides no public purpose, would not be useful as a 19 non-motorized transportation facility, or provide usable access to adjoining properties; and for present or future street purposes; and WHEREAS, the proposed vacation is of a minor nature and is consistent with the General Plan of the City, NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Carlsbad, California, as follows: 20 21 22 23 1. That the above recitations are true and correct. 24 2. 25 That pursuant to Chapter 4, Part 3, Division 9 of the California Street and Highways 26 Code, said excess right-of-way more particularly described in Exhibit A, and shown for the sake of 27 clarity in Exhibit B, be summarily vacated. 28 3. That easements and rights necessary to maintain, operate, replace, remove, or renew in-place public facilities are reserved and excepted from the vacation. II 1 4. The City Clerk is directed to record this resolution, the attached legal description 2 and plat in the offrce of the County Recorder of San Diego County. 3 5. From the date the resolution is recorded in the County Recorder’s office, the area 4 vacated no longer constitutes a public street. 5 6 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council 7 held on the 5th day of June , 2001 by the following vote, to wit: 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 AYES: Council Members Lewis, Kulchin, Nygaard, and NOES: None.
