A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING AMENDMENT NO. 3
TO THE PROFESSIONAL SERVICES AGREEMENT WITH
SIMON WONG ENGINEERING FOR AS-NEEDED CONSULTANT
INSPECTION AND PROJECT MANAGEMENT SERVICES.
WHEREAS, the City Council of the City of Carlsbad, California considers it necessary and
in the public interest to approve and accept Amendment No. 3 to the Professional Services
Agreement with Simon Wong Engineering;
WHEREAS, the Parties desire to extend the Agreement for a period of one year, ending
December 1, 2002, with the ability to extend the agreement for two additional one year
extensions; and
WHEREAS, the Parties further desire to amend the Agreement’s scope of work to
increase the yearly fees, beginning with the current year, by $150,000 for a total Agreement
amount of $350,000; and
WHEREAS, the Parties have negotiated and agreed to a supplemental scope of work and
fee schedule, which is attached to and incorporated by this reference as Exhibit “A”, Scope of
Services and Fee; and
WHEREAS, the contractor, Simon Wong Engineering possesses the necessary skills and
qualifications to provide the needed services; and
WHEREAS, an amendment to the consultant agreement with Simon Wong Engineering
has been prepared and submitted hereto; and
WHEREAS, funding for the subject amendment is available in the Fiscal Year 2001/02
Engineering operating budget.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
1 2. That Amendment No. 3 to the agreement between the City of Carlsbad and Simon
2 Wong Engineering is hereby approved in the amount of $350,000 and the Mayor is authorized
3 and directed to execute said amendment.

PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council

held on the 21st day of Auqust , 2001 by the following vote, to
7 wit:
8 AYES: Council Members Lewis, Kulchin, Nygaard, Finnila, and Hall.
9 NOES: None.

EXHIBIT “A”
Provide construction inspection and project management services satisfactory to the
City of Carlsbad on an as-needed basis.
Principal Civil Engineer $125.00/hr
Sr. Structures Representative $101 .OO/hr
Project Manager $ 98.00/hr
Construction Manager $ 98.00/hr
Structure Representative $ 84.00/hr
Construction Inspector (prevailing wages) $ 77.50/hr
Construction Inspector (non-prevailing wages) $ 66.00/hr
Rates are per hour and include vehicle and mileage, cell phone, and all incidentals
necessary to perform the service. Work performed over and above 8 hours on a given
day or on Saturdays will be paid at the same rates as above. One lap top computer
and printer may be required whenever a personnel class is assigned to a distinct project
or group of projects.
