HomeMy WebLinkAbout2001-09-18; City Council; Resolution 2001-2801 2 3 4 5 6 7 6 9 10 11 12 13 14 15 16 17 16 19 20 21 22 23 24 25 26 27 26 II RESOLUTION NO. 2001-280 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A QUITCLAIM DEED FOR THE SLOPE AND TEMPORARY CONSTRUCTION EASEMENT ACROSS A PORTION OF THE GALLAGHER/CAMERON PROPERTY AT THE SOUTHWEST CORNER OF POINSETTIA LANE AND BLACK RAIL ROAD. WHEREAS, the Gallagher Family Trust and Laird Cameron and Catherine Ann Cameron have requested the quitclaim of slope and temporary construction easements over a portion of their property located at the southwest corner of the intersection of Poinsettia Lane and Black Rail Road; and WHEREAS, pursuant to the court order pertaining to City of Carlsbad v. Gallagher (SDSC Case No. N78253-1) regarding the acquisition of right-of-way for the Poinsettia Lane extension, the City is required to quitclaim the slope and temporary construction easements to the property owner (APN 215-070-33); and WHEREAS, the quitclaim deed for slope and temporary construction easements attached and incorporated by reference, provides a legal description and plat that accurately describes the easements to be quitclaimed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California as follows: 1. That the above recitations are true and correct. /I/ I// !/I I// ill ill I// Ill 1 2. That the quitclaim deed conveying slope and temporary construction easements 2 over a portion of APN 215-070-33 to Norman G. Gallagher and Debra L.
