HomeMy WebLinkAbout2001-12-11; City Council; Resolution 2001-361RESOLUTION NO. 2001-361 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, TO EXTEND THE COLLECTION OF VEHICLE REGISTRATION FEES FOR THE PURPOSES OF ABANDONED VEHICLE ABATEMENT 5 WHEREAS, sections 9250.7 and 22710 of the California Vehicle Code authorized the 6 establishment of the San Diego County Abandoned Vehicle Abatement Service Authority 7 (“AVASA”) in 1991 and the imposition of a $1 fee on vehicles registered in the County of San WHEREAS, these sections impose an additional $2 fee on commercial vehicles registered in the County of San Diego, effective December 31, 2001; WHEREAS, these registration fees are used exclusively for the abatement, removal, and disposal of any abandoned, wrecked, dismantled, or inoperative vehicles or vehicle parts as 9 IO 11 12 13 ,4 public nuisances, on private or public property, to combat neighborhood blight and decay; 15 WHEREAS, the City of Carlsbad, along with the County of San Diego and the majority of ,6 cities in the County, is a member of the AVASA; 17 WHEREAS, in FY 2001, the City of Carlsbad received $123,351 in registration fees from 18 the AVASA, which paid for 100 percent of the City’s costs of abating nuisance vehicles with the 19 balance going into a reserve fund for future Carlsbad AVA expenditures; 20 WHEREAS, Senate Bill 106, chaptered on August 13, 2001, amended California Vehicle 21 Code sections 9250.7 and 22710 to allow for an extension of the registration fees in increments of 22 /I up to 10 years; 23 WHEREAS, in order for the registration fees to be extended, Senate Bill 106 requires a 24 county’s board of supervisors, by a two-thirds vote, and the cities with the majority of the 25 incorporated population within the county to adopt resolutions approving an extension of the 26 registration fees; 27 28 NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad, that the registration fees, as authorized by the State of California, imposed on vehicles registered in 1 2 3 4 5 6 7 8 9 10 11 12 13 14 16 17 18 19 20 21 22 23 24 25 26 27 28 the County of San Diego, are extended for 10 years from date of the approval of this Resolution, in accord with California Vehicle Code sections 9250.7 and 22710.
