HomeMy WebLinkAbout2002-01-08; City Council; Resolution 2002-005RESOLUTION NO, 2002-005 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A QUITCLAIM OF EXISTING SLOPE AND TEMPORARY CONSTRUCTION EASEMENTS ALONG BOTH SIDES OF AVIARA PARKWAY AT PALOMAR AIRPORT ROAD. WHEREAS, existing slope and temporary construction easements along both sides of 6 Aviara Parkway at Palomar Airport Road, and these easements were granted to the City of 7 Carlsbad via a Final Order of Condemnation issued on December 9, 1998, per document No. * 1998-0798577 for the purposes of constructing improvements to Aviara Parkway; and 9 WHEREAS, the slope and temporary construction easements are to be quitclaimed once IO the improvements to Aviara Parkway are accepted by the City pursuant to stipulated judgments 11 filed at the County of San Diego on September 22, 1998; and '12 WHEREAS, the improvements for Aviara Parkway were accepted by the City on May 21, 13 14 15 16 17 WHEREAS, the City Council of the City of Carlsbad has determined it to be in the public interest to quitclaim said easement; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, I8 California, as follows: 19 1. That the above recitations are true and correct. 2001; and WHEREAS, staff has determined the easements are no longer required for their intended use; and 20 21 22 23 24 25 26 27 28 2. That the Quitclaim Deeds releasing interest to the existing slope and temporary construction easements along both sides of Aviara Parkway at Palomar Airport Road, which is on file with the City Clerk and is incorporated by this reference; is approved. That the Mayor is authorized to execute both Quitclaim Deeds and the City Clerk is hereby authorized to cause the original Quitclaim Deeds to be recorded in the Office of the County Recorder of San Diego County, State of California.
